<br /> -8- <br /> 12.5 Whenever a period of time is prescribed for action to be <br /> taken by either party, the party shall not be liable or <br /> responsible for, and there shall be excluded from the computation <br /> of any such period of time, any delays due to strikes, riots, acts <br /> of God, shortages of labor or materials, war, governmental laws, <br /> regulations, or restrictions or any other causes of any kind which <br /> are beyond the reasonable control of that party. <br /> 12.6 The CITY covenants and agrees that, upon payment by HS of the <br /> rent and all other sums and upon the observance and performance of <br /> all of the covenants and agreements on the HS's part to be <br /> observed and performed, HS shall, subject to the terms and <br /> provisions of this Lease, at all times during the continuance of <br /> this Lease have the peaceable and quiet enjoyment and possession <br /> of the premises. <br /> 12.7 Nothing in this Lease shall be deemed or construed by the <br /> parties, nor by any third party, as creating the relationship of <br /> principal and agent or of partnership or of joint venture between <br /> the parties. It is understood and agreed that neither the method <br /> of computation of rent, nor any other provision of the Lease, nor <br /> any acts of the parties, shall be deemed to create any <br /> relationship between the parties other than the relationship of <br /> landlord and tenant. <br /> 12.8 HS warrants that it has no dealings with any broker.or agent <br /> in connection with the negotiation or execution of this Lease and <br /> HS agrees to indemnify and hold the CITY harmless from and against <br /> any and all costs, expense or liability for commissions or other <br /> compensations and charges claimed by any broker or agent with <br /> respect to this Lease. <br /> 12.9 Should HS fail to pay when due any rent, or any other sum <br /> payable to the CITY under the terms of this Lease, the CITY may <br /> charge interest at the maximum legal rate payable in the State of <br /> Texas and the interest shall accrue from and after the date on <br /> which it shall be due and payable. The interest shall be paid by <br /> the HS to the CITY at the time of payment of the sum upon which <br /> the interest shall have accrued. <br /> 12.10 HS shall not discriminate on the basis of race, creed, color, <br /> religion, age, sex or national origin in the provision of any 0 f <br /> its services and assistance. <br />
