<br /> construction, and other costs which are the responsibility of the <br /> Owner, including those described in this Article 2 and in <br /> Subparagraph 3.1.2. The Engineer shall accept the Owner's <br /> authorization to bid the Project as evidence that arrangements <br /> exist for fulfillment of the financial obligations assumed by the <br /> Owner hereunder. <br /> 2.3 The Owner shall designate a representative authorized to <br /> act in the Owner's behalf with respect to the Project. The Owner <br /> and/or such authorized representative shall examine the documents <br /> submitted by the Engineer and shall render responses pertaining <br /> thereto promptly and provide Engineer with requested data or <br /> information in Owner's possession relating to the Project. For <br /> the purposes of this agreement the Owner's Director of Public <br /> Works is hereby designated as the Owner's Representative. <br /> 2.4 The Owner shall provide access to and make all necessary <br /> provisions for the Engineer to enter upon public and private <br /> property as required for the Engineer to perform its services <br /> under this Agreement. <br /> 2.5 The Owner shall furnish structural, mechanical, chemical <br /> and other laboratory tests, inspections and reports as required by <br /> law or the construction contract documents or as reasonably needed <br /> by the Engineer. The Engineer shall not be held responsible for <br /> its reliance on any such information supplied by Owner provided <br /> that Engineer does not know or reasonably cannot be expected to <br /> know of any deficiency or error in such information supplied by <br /> Owner. <br /> -l2- <br />
