<br /> -3- <br /> SECTION 9. That Subsections (c) , ( 1) , (m) and <br />Subdivision (3) of Subsection (f) of Section 9-7 of the San <br />Marcos Code of Ordinances are hereby amended to read as <br />follows: <br />Sec. 9-7. Amendments to the National Electrical Code. <br /> (e) Nonmetallic-sheathed cable (Article 336) and <br /> shielded nonmetallic-sheathed cable (Article 337) shall <br /> be permitted to be used only in dwellings, as defined in <br /> Article lØØ. These cable types shall not be used in <br /> hotels, motels, rooming houses with more than two tenant <br /> sleeping quarters, fraternity and sorority houses, or <br /> buildings located in the Central Business Area District <br /> as defined in Appendix A, General Zoning Ordinance, of <br /> the Code of Ordinances of the City. <br /> (f)(3) No more than twelve (12) outlets shall be <br /> installed per circuit serving geDeral lighting <br /> circuits. No more than six (6) outlets shall be <br /> installed on each GFCI circuit. Outlets serving the <br /> small appliance branch circuit for counter tops shall be <br /> limited to three (3) outlets per circuit. This rule <br /> does not apply to non-residential occupancies. Such <br /> circuits shall be calculated in accordance with Article <br /> 221-22, 2lØ-23 and 22Ø-3. <br /> (1) Overhead service entrance conductors shall be in <br /> either rigid metal cond ui t, intermediate metal conduit, <br /> or electrical metallic tubing. Service entrance cable <br /> (Article 338 NEC) will not be authorized unless <br /> protected by approved conduit. If the service entrance <br /> conduit is a service mast, then only two-inch or larger <br /> rigid metal conduit or intermediate metal conduit shall <br /> be used. <br /> (m) Flexible metal conduit (Article 35Ø, NEC) shall not <br /> be used in wet locations. <br /> SECTION lØ. That Subsection (a) of Section 9-8 of the <br />San Marcos Code of Ordinances is hereby amended to read as <br />follows: <br /> Sec. 9-8. Exemptions. <br /> (a) All electrical work under construction or formally <br /> contracted for at the time of passage of this chapter <br /> shall be exempted from the prOV1Slons of this chapter. <br /> If the occupancy classification, as determined in the <br /> Standard Building Code, of any existing building or <br /> structure is changed, then electrical equipment and <br /> systems shall be made to conform with the app 1 icab le <br /> provisions of this Chapter. <br /> SECTION 11. That if any word, phrase, clause, sentence, <br />or paragraph of this ordinance is held to be unconstitutional <br />or invalid by a court of competent jurisdiction, the <br />remaining provisions of this ordinance shall remain in effect <br />as if the unconstitutional or invalid portion had not been <br />adopted. <br /> SECTION 12. That all ordinances and resolutions or <br />parts of ordinances or resolutions in conflict herewith are <br />hereby repealed. <br /> SECTION 13. That any person violating any provision of <br />this ordinance shall be deemed guilty of a misdemeanor and <br />upon conviction shall be subject to the penalty provided in <br />Section 1-5 of the San Marcos Code of Ordinances. <br />
