<br />46 <br /> <br /> <br /> <br />This AGREEMENT is made this the 25th day of JUllf'- , <br />19 9l ,between the CITY OF SAN MARCOS, TEXAS, hereinafter referred to <br />as "CITY", 630 East Hopkins, San Marcos, Texas 78666, and PHILLIPS <br />SWAGER ASSOCIATES, 13747 Montfort Drive, Suite 106, Dallas, Texas <br />75240, hereinafter referred to as "ARCHITECT", for architectural <br />services in connection with the conversion of an existing building and <br />associated site located at 2300 IH-35 South in San Marcos, Texas into a <br />new headquarters and training facility for the San Marcos Police <br />Department. <br />WITNESSETH: OWNER and ARCHITECT do hereby agree as follows: <br />ARTICLE 1 <br />ARCHIftC'.r' S SERVICES AID) RESPOIfSIBILI~IES <br />ARCHITECT shall be responsible for the proper, accurate and <br />adequate design and preparation of plans and specifications and other <br />construction contract documents and for contract administration for the <br />following buildings and facilities located or to be constructed on the <br />City's ll. 98 acre site located at 2300 IH-35 South in San Marcos, <br />Texas. <br />(a) Headquarters Building; <br />(b) Training Facility <br />(c) Driving Track; and <br />(d) Shooting Range; <br />Hereinafter collectively referred to as the "Project." Any <br />provisions in this Agreement pertaining to CITY I S review, approval <br />and/or acceptance of plans, specifications, construction contract <br />documents, or other written materials prepared by ARCHITECT and/or its <br />consultants, contractors, and subcontractors in connection with this <br />Project shall not be deemed to diminish ARCHITECT I S responsibility <br />therefor. The ARCHITECT's Basic Services shall consist of the <br />following phases described in Paragraphs 1.l through 1.5 and include <br />normal architectural, structural, mechanical, civil and electrical <br />engineering services. Certain portions of the ARCHITECT's Basic <br />Services are to be performed through the following consulting <br />disciplines as subcontractors to the ARCHITECT: <br /> <br /> <br /> <br />-1- <br />
