<br />- <br />~ 75 <br />(!"" <br /> <br /> <br /> <br />ORDINANCE 1991- 34 <br /> <br />I;J <br />2: <br />~- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />0 OF SAN MARCOS, TEXAS, AMENDING APPENDIX <br />A-GENERAL ZONING ORDINANCE OF THE CODE OF <br />ORDINANCES OF THE CITY BY AMENDING THE <br />DEFINITIONS OF BUILDING SETBACK LINE, <br />- FRATERNAL BUILDING, FRATERNITY OR SORORITY <br />~ BUILDING AND FRONT YARD IN SECTION 4¡ AMENDING <br />-;- SECTION 26 (A) (1) TO INCLUDE CHURCHES AS A <br />""', PERMITTED USE IN THE "P" PUBLIC AND <br />'F"" <br />INSTITUTIONAL DISTRICT; AMENDING SECTION 29 TO <br />CHANGE THE NAME OF THE "OP" OFFICE <br />PROFESSIONAL DISTRICT TO "LB" LIMITED BUSINESS <br />-- DISTRICT¡ ADDING MAXIMUM HEIGHT REQUIREMENTS <br />~ AND ADDING SMALL RETAIL OR NEIGHBORHOOD <br />;.-.> <br />- ORIENTED BUSINESSES AS PERMITTED AND SPECIFIC <br />USES IN THE "LB" LIMITED BUSINESS DISTRICT ¡ <br />AMENDING SECTION 30 TO REVISE THE LIST OF <br />PERMITTED USES IN THE "c" COMMERCIAL DISTRICT; <br />DELETING THE STATEMENT OF PURPOSE AND AMENDING <br />THE LISTS OF PERMITTED AND SPECIFIC USES IN <br />SECTION 32, "LI" LIGHT INDUSTRIAL DISTRICT ¡ <br />AMENDING THE LISTS OF PERMITTED AND SPECIFIC <br />USES IN SECTION 33, "I" INDUSTRIAL DISTRICT; <br />AMENDING SECTION 35 TO CHANGE THE REQUIRED <br />PERIOD FOR WRITTEN NOTIFICATION TO PROPERTY <br />OWNERS FOR SPECIFIC USE PERMIT APPLICATIONS; <br />AMENDING THE REQUIREMENTS IN SECTION 35 <br />REGARDING ESTABLISHMENTS DISPENSING LIQUOR FOR <br />ON-PREMISE CONSUMPTION; AMENDING SECTION 36 BY <br />CHANGING THE TITLE TO "SUPPLEMENTAL <br />REQUIREMENTS," CLARIFYING THE EXISTING TEXT <br />AND ADDING PROVISIONS ':CO ALLOW AN EXISTING <br />DWELLING OR MOBILE HOME TO TEMPORARILY REMAIN <br />ON A RESIDENTIAL LOT ZONED "R-1", "R-2", OR <br />"MR" DURING THE CONSTRUCTION OF A NEW <br />SINGLE-FAMILY DWELLING ON THE SAME LOT; <br />REPLACING THE TERM "FIREWALL" WITH A MORE <br />ACCURATE DESCRIPTION AND AMENDING THE <br />RESTRICTIONS ON FENCES AND OTHER OBSTRUCTIONS; <br />AMENDING SECTION 37 REGARDING MINIMUM <br />OFF-STREET PARKING REQUIREMENTS FOR EATING AND <br />DRINKING ESTABLISHMENTS; PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES i PROVIDING A PENALTY ¡ PROVIDING FOR <br />PUBLICATION¡ AND PROVIDING AN EFFECTIVE DATE. <br /> <br /> <br />WHEREAS, on November 7, 1989, the Zoning Commission of the <br />City (the "Commission") held a public hearing to consider <br />amendments to the following sections of the General Zoning <br />Ordinance: Section 26 (A) (1), "P" Public and Institutional District¡ <br />Section 35(B) (1), Specific Use Permits¡ and, <br /> <br />WHEREAS, subsequent to that public hearing, the Commission <br />considered the amendments and voted to approve amendments to <br />Section 26(A) (1), "P" Public and Institutional District¡ and has <br />recommended that these amendments be approved by the City Council¡ <br />and, <br /> <br />WHEREAS, on December 5, 1989, the Commission held a public <br />hearing to consider amendments to the following sections of the <br />General Zoning Ordinance: section 4, Definitions (15) and (105) (a); <br />Section 32, "LI" Light Industrial District; Section 33, "I" <br />Industrial District; section 35 (B) (1), Specific Use Permits; <br />Section 36(F) and (J), Supplemental Area Requirements; and Section <br />37(A) (11) and (11.5), Off-Street Parking; and, <br /> <br />WHEREAS, subsequent to that public hearing, the Commission <br />considered the amendments and voted to approve all amendments <br />
