<br /> -5- <br /> referenced in Sec. 29(A) (8), above. <br /> (5) Hospitals. <br /> (6) Restaurants or self-service laundries, subj ect to <br /> the same limitations required in subsection (A) (8), <br /> above, except that the restaurants may have a <br /> direct outside entrance for customers and may be a <br /> principal use. <br /> (C) Area Requirements: <br /> (9) Maximum height of structures: 45 feet or 3 <br /> stories, whichever is less. <br /> SECTION 4. That Section 30(A) of Appendix A, General Zoning <br />Ordinance of the San Marcos Code of Ordinances is amended to read <br />as follows: <br /> SECTION 30. C COMMERCIAL DISTRICT. <br /> (A) Permitted uses: <br /> (1) Any use permitted in the LB District, including <br /> specific uses, but excluding mixed use buildings <br /> and uses listed as permitted or specific uses in <br /> the MF-4 District; provided that all permanent <br /> outdoor storage areas are screened from public <br /> view, and without restrictions as to vehicle fuel <br /> or service facilities, vehicle drive-up or drive- <br /> through facilities, outdoor storage and size or <br /> capacity. <br /> (2) Hotel, motel. <br /> (3) Personal storage mini-warehouse. <br /> (4) Any other retail or service use, or light <br /> distribution facilities provided such use is not <br /> noxious or offensive by reason of the emission of <br /> odors, dust, noise, gas, fumes, vibrations, or <br /> soot, but excluding any uses specifically listed <br /> as permitted in the "LI" or "I" districts. All <br /> permanent outdoor storage areas shall be screened <br /> from public view. <br /> (5) Use of the property as a sexually oriented <br /> business for which a license has been duly issued <br /> under Chapter 37 of the Code of Ordinances. <br /> SECTION 5. That Section 32(A) and (B) of Appendix A, General <br />Zoning Ordinance of the San Marcos Code of Ordinances is amended by <br />the deletion of subsection (A)-Statement of Purpose in its <br />entirety, amending the lists of permitted uses and specific uses <br />and renumbering in proper sequential order, with the revised <br />subsections A and B to read as follows: <br /> (A) Permitted uses: <br /> (1) Automotive body/paint shops, and repair <br /> businesses which include engine overhauling. <br /> (2) Farm, construction, or other heavy equipment <br /> sales and service. <br /> (3) Temporary storage or impoundment of operable or <br /> repairable motor vehicles. <br /> (4) Lumber yards or contractor yards. <br />
