<br /> 39 <br /> ORDINANCE 1991- 46 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING CHAPTER 30, WATER, <br /> SEWERS AND SEWAGE DISPOSAL, OF THE SAN MARCOS <br /> CODE OF ORDINANCES TO AMEND SERVICE CHARGE <br /> POLICIES FOR WATER AND SEWER SERVICES TO PROVIDE <br /> FOR CONSOLIDATED UTILITY BILLING; PROVIDING FOR <br /> SEVERABILITY; REPEALING ALL CONFLICTING <br /> ORDINANCES; PROVIDING FOR A PENALTY; PROVIDING <br /> FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> WHEREAS, certain changes to the City's policies pertaining to <br />service charges for water and sewer services are necessary as part <br />of the City's consolidation of billing for water, sewer and <br />electric utility services; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> SECTION 1. That Division 1, Generally, of Article II, Service <br />Charges, of Chapter 30, Water, Sewers and Sewage Disposal, of the <br />San Marcos Code of Ordinances is hereby amended to read as follows: <br /> DIVISION 1. GENERALLY <br /> Sec. 30-17. Connection of all city utilities required. <br /> <br /> A person desiring the institution of city water, sewer or <br /> electric utility service must institute, at the same time, <br /> all ,of such services as are available to the person's <br /> prem1ses. <br /> Sec. 30-18. DeDosits. <br /> <br /> (a) Each applicant for water and/or sewer service shall <br /> make a cash deposit with the city to establish or re- <br /> establish credit before service will be instituted. <br /> (b) The requirement for a deposit shall be waived: <br /> (1) If the applicant has been a customer of city <br /> utility service at a location within the past <br /> twelve (12) months, and had service at that <br /> location for a minimum of three (3) years, and <br /> during the last twenty-four (24) consecutive <br /> months of service did not have more than two (2) <br /> occasions in which a bill for such utility <br /> service was paid after becoming delinquent; or <br /> (2) If a new applicant is allowed to submit a letter <br /> of credit in lieu of deposit to the city <br /> electric utility, or the applicant's deposit <br /> would exceed $5,000.00. In such cases, the new <br /> applicant may provide the city with an <br /> irrevocable letter of credit from a bank or <br /> lending institution approved by the city in the <br /> amount of the deposit that would otherwise <br /> apply. <br /> (c) The amount of the deposit for water and/or sewer <br /> service shall be as follows: <br /> (1) Individually metered residential <br /> unit..............~.................$35.00 <br />
