<br />(b) The reconnect service fee shall be $10.00 each for <br />water and sewer reconnect ions if a customer applies for <br />service before 4:00 p.m., and $15.00 each if a customer <br />applies after 4:00 p.m., but before 5:00 p.m. in order to <br />be reconnected the same day. <br />Sec. 30-22. DisDuted bills other than meter error. <br /> <br />(a) A water and/or sewer utility service customer may <br />request an explanation from the city of any bill for <br />utility services that the customer believes is in error. <br />The city Finance and/or Public Works Departments shall <br />provide an explanation in response to each such request. <br />Requests involving alleged meter error shall be resolved <br />under Section 30-23. <br />(b) If a customer is not satisfied with the explanatio~ <br />provided under (a) above, the customer may submit a written <br />request to the Finance Department for an investigation of <br />the disputed bill, setting forth all informa~ion relative <br />to the dispute. The Finance Department shall investigate <br />the matter promptly, and submit its findings in writing to <br />the customer. Any overpayment shall be refunded at that <br />time and any underpayment shall be due at that time. <br />(c) If a customer is dissatisfied by the findings under <br />(b) above, the customer may submit an appeal of the <br />findings to the city manager stating specifically the <br />points of disagreement with the findings. The city manager <br />shall consider the appeal, together with the response of <br />the Finance Department, and shall promptly render a written <br />decision on the matter. This decision shall be final as to <br />the city's position on the matter. Any overpaYment shall <br />be refunded at that time and any underpayment shall be due <br />at that time. <br />Sec. 30-23. DisDuted bills based on meter error. <br /> <br />(a) If a dispute regarding a water and/or sewer utility <br />service bill is based on a claim that the water meter is <br />registering inaccurately, the customer may submit a written <br />request that the meter be tested. <br />(b) The meter shall be tested during normal business hours <br />either on the customer's premises or at a testing facility. <br />The customer shall be given reasonable advance notice of <br />the time and place of the test, and shall be permitted to <br />attend the test. <br />(c) If the meter is determined to be registering within <br />the accuracy standards of the American National Standards <br />Institute (or AWWA), then the customer shall pay a $15.00 <br />meter test charge. If the meter is determined to be <br />registering outside the standards, an adjustment in the <br />customer's bill based on the level of inaccuracy shall be <br />made as a credit to the customer's account for a period of <br />either the preceding six (6) months or for the period of <br />time the account has been in the customer's name, whichever <br />is shorter, and the city shall pay all costs of the meter <br />test. <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br />SECTION 3. That all ordinances or parts of ordinances in <br />conflict herewith, including without limitation Sections 30-7,30- <br />8,30-28,30-26 and 30-37 of the San Marcos Code of Ordinances, are <br />hereby repealed. <br />
