Brown and others. <br /> Mayor Craddock called the meeting to order at 5:30 p.m. <br /> Mayor Craddock introduced for consideration a discussion of what ac- <br /> tion needed to be taken by Staff relative to the issuance of a build- <br /> ing permit to the Holland Hills Townhouse Subdivision. City Manager <br /> Gonzalez stated the Witte suit had been settled in March, 1982. The <br /> new owner of the property, Trias Ventures Corporation, has come in for <br /> a building permit. It was the Council's intention at the time of the <br /> settlement agreement with Mr. Witte, to exempt the Holland Hills, Inc. <br /> townhouse development from the Drainage and Erosion Control Ordinance. <br /> The Drainage and Erosion Control Ordinance would not apply to properties <br /> platted prior to the effective date of the Ordinance, and the plat to <br /> the project has never been recorded at the Courthouse. The Staff <br /> asked for direction from the Council as to issuance of the building <br /> permit. Gary Unruh of Trias Ventures Corporation stated they would <br /> not have bought the property to develop the townhouse project if they <br /> had known they would have to meet the guidelines of the Drainage and <br /> Erosion Control Ordinance. After much discussion Mayor Craddock moved <br /> to direct Staff to issue the building permit to Trias Ventures Corpora- <br /> tion under all of the City's guidelines and laws except the Drainage <br /> and Erosion Control Ordinance but told Mr. Unruh they would have to <br /> make plans to minimize the soil erosion to protect our river. Mr. <br /> Guerra seconded the motion. On roll call the following vote was re- <br /> corded: <br /> AYE: Farr, Guerra, Craddock, Kreczmer. <br /> NAY: Brown. <br /> ABSTAIN: None. <br /> Mayor Craddock introduced for consideration approval of an Annexation <br /> Ordinance on second reading, which Ordinance was read in its entirety <br /> because it was not made available for the public's review at least <br /> 72 hours before its consideration at this meeting, the caption which <br /> was read as follows (Armco): <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, ANNEXING TO SAID CITY A CONTIGUOUS <br /> TRACT OF LAND CONTAINING 78.23 ACRES OF LAND OUT OF <br /> THE J.
