28 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, JUNE 15, 1983 PRESENT: Mayor Emmie Craddock Council Members Karl W. Brown Gerald G. Farr Fred Guerra * Betty Jane Kissler John A. Kreczmer * Jaime Moore City Manager A. C. Gonzalez City Secretary Janis K. Womack City Attorney Barbara Jean Edwards Also Present: Everett Jantz, Gary Unruh, Jeff Watkins, Chester Witte, Tom Partin, Bill Nicola, Anna Farr, James S. Brown and others. Mayor Craddock called the meeting to order at 5:30 p.m. Mayor Craddock introduced for consideration a discussion of what ac- tion needed to be taken by Staff relative to the issuance of a build- ing permit to the Holland Hills Townhouse Subdivision. City Manager Gonzalez stated the Witte suit had been settled in March, 1982. The new owner of the property, Trias Ventures Corporation, has come in for a building permit. It was the Council's intention at the time of the settlement agreement with Mr. Witte, to exempt the Holland Hills, Inc. townhouse development from the Drainage and Erosion Control Ordinance. The Drainage and Erosion Control Ordinance would not apply to properties platted prior to the effective date of the Ordinance, and the plat to the project has never been recorded at the Courthouse. The Staff asked for direction from the Council as to issuance of the building permit. Gary Unruh of Trias Ventures Corporation stated they would not have bought the property to develop the townhouse project if they had known they would have to meet the guidelines of the Drainage and Erosion Control Ordinance. After much discussion Mayor Craddock moved to direct Staff to issue the building permit to Trias Ventures Corpora- tion under all of the City's guidelines and laws except the Drainage and Erosion Control Ordinance but told Mr. Unruh they would have to make plans to minimize the soil erosion to protect our river. Mr. Guerra seconded the motion. On roll call the following vote was re- corded: AYE: Farr, Guerra, Craddock, Kreczmer. NAY: Brown. ABSTAIN: None. Mayor Craddock introduced for consideration approval of an Annexation Ordinance on second reading, which Ordinance was read in its entirety because it was not made available for the public's review at least 72 hours before its consideration at this meeting, the caption which was read as follows (Armco): AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO SAID CITY A CONTIGUOUS TRACT OF LAND CONTAINING 78.23 ACRES OF LAND OUT OF THE J. M. VERAMENDI LEAGUE NO. 1, HAYS COUNTY, TEXAS, LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF * Ms. Kissler and Mr. Moore were not present at this meeting.
