<br /> Page 17 <br /> 5.2 New accounts added after the first day of the month shall <br /> be counted as having received service for a full month. Accounts <br /> discontinued during a given month shall be regarded as not having <br /> received service for that month. <br /> 5.3 Should the CONTRAC'l'OR disagree with the City's records <br /> regarding the number of units serviced for a given month, the <br /> COftRAC"l'OR will specify the nature of the disagreement, the <br /> address (es) of the unites) in question, and the date the service <br /> began or ended. The CI~ shall investigate reported discrepancies <br /> and confirm or deny the CORTRACTOR"s request. The CI~"s decision <br /> shall be final. The CONTRAC'l'OR shall continue to provide <br /> collection services until the problem is resolved. <br /> ARTICLE 6 <br /> IIISCRT.T.ÄQOUS PROVISIOllS <br /> <br /> 6.1 ADIIIRISTRA'l'OR OF CORTRACT In all matters pertaining to the <br /> performance of this contract, the CI~"s point of contact shall be <br /> the Assistant Director of Public Works or the Assistant <br /> Director's authorized representative. <br /> 6.2 This Contract shall be governed by the laws of the State of <br /> Texas. Exclusive venue for any dispute arising under this <br /> Contract shall be in Hays County, Texas. <br /> 6.3 As between the parties to this Contract, as to all acts or <br /> failures to act by either party to this Contract, any applicable <br /> statute of limitations shall commence to run and any alleged cause <br /> of action shall be deemed to have accrued in any and all events <br />
