Box 220 <br />Austin, Texas 78767-0220 <br /> <br />Dear Mark, <br /> <br />This letter agreement between Lower Colorado River Authority <br />("LCRA") and the City of San Marcos (the "City") reflects the <br />way in which LCRA and the City have agreed to handle the <br />issues addressed herein concerning the transfer of the <br />emploYment of employees of LCRA located in the San Marcos <br />District to employment with the city. <br /> <br />It is the City's understanding that the employees of LCRA who <br />are located in the San Marcos District will transfer their <br />employment from LCRA to the City at 8: 00 a. m. on October 1, <br />1991. LCRA will terminate the emploYment of transferring <br />employees effective at 7:59 a.m. on October 1, 1991. <br /> <br />On October 1, 1991, LCRA will transfer to the City, for <br />credit on the City's books and the benefit of transferring <br />employees, .the actual amount of sick leave accrued by each <br />transferring employee with LCRA as of October 1, 1991, or 550 <br />hours of sick leave, whichever is'less. LCRA agrees to pay <br />the City one-half of the cost of sick leave actually used by <br />each transferring employee until October 1, 1996 or until all <br />sick leave transferred by LCRA for the transferring employee <br />in question has been exhausted, whichever is earlier; <br />provided, however, that such paYment by LCRA will be limited <br />to one-half of the cost of sick leave actually used by and <br />transferred on behalf of each employee transferring from LCRA <br />to the City; provided further that the amount of paYment due <br />by LCRA will be calculated based on the transferring <br />employee I s rate of pay on the date on vlhich such sick leave <br />is taken. Exhaustion of transferred sick leave will be <br />determined on an individual, rather than an aggregate, <br />basis. The City will be solely responsible for all sick <br />leave used by a transferring employee after October 1, 1996 <br />or after all transferred sick leave is exhausted, whichever <br />is earlier. <br /> <br /> <br /> <br /> <br /> <br />630 East Hopkins.
