<br /> -20- <br /> (b) May at any reasonable time have access to any <br /> records required by this Article pertaining to <br /> industrial wastes as determined by the <br /> Director; <br /> (c) May inspect any monitoring equipment or <br /> methods of pretreatment monitoring required by <br /> the Director and sample any effluents which <br /> the user of the source is required to sample. <br /> Sec. 30-106. Leqal actions. <br /> <br /> If any person discharges sewage, industrial waste or <br /> wastes into the city's wastewater disposal system contrary <br /> to the provisions of this Article, state requirements, <br /> federal pretreatment requirements, or any order of the city, <br /> the City Attorney may commence an action for appropriate <br /> legal and/or equitable relief in a court of competent <br /> jurisdiction. <br /> Sec. 30-107. Penalties. <br /> (a) Any person who violates any provision of this <br /> Article or any order or permit issued hereunder or who fails <br /> to comply with any provision hereof may be fined not less <br /> than one hundred dollars ($100.00) nor more than the maximum <br /> allowed by the Texas Water Code, section 26.213, and each <br /> day that such violation occurs or continues shall constitute <br /> a separate offense. The Control Authority is hereby granted <br /> a minimum penalty authority of one thousand dollars <br /> ($l,OOO.OO) in accordance with 40 CFR 403.8(f) (l) (vi) (A). <br /> The Cðntrol Authority may impose additional penalties as <br /> described iTh Section 30-101. above. <br /> (b) Any person violating any of the provisions of this <br /> Article shall be liable to the city for any expense, loss or <br /> damage incurred by the city by reason of such violation. In <br /> addi tion to the penal ties provided herein, the city may <br /> recover reasonable attorney's fees, court costs, court <br /> reporter's fees and other expenses of litigation by <br /> appropriate suit against the person found to have violated <br /> this Article or the orders, rules, regulations and permits <br /> issued hereunder. <br /> (c) The Control Authority is further authorized to <br /> prosecute and seek all criminal and civil remedies in the <br /> various courts as set forth in the Texas Water Code, Chapter <br /> 26, Water Quality Control, Subchapter D-Prohibition Against <br /> Pollution; Enforcement, Subchapter E-Authority of Local <br /> Government; and Subchapter F-Criminal Prosecution, for all <br /> violations of this Article or violations of any conditions <br /> of a permit granted by the Control Authority. <br /> Sec. 30-108. Public Notice of Violation. <br /> A notice shall be placed in local newspapers each year as <br /> required by 40 CFR 403.8(f)(2) (vii) for significant <br /> violators. The notification shall include the industry name <br /> and address plus a description of violation(s). The <br /> notification shall be for a designated twelve (12) month <br /> period. <br /> Sec. 30-109. Rules and orocedures. <br /> The Director shall adopt rules and procedures in the form <br /> of a procedures manual consistent with this Article, to <br /> effectuate its purpose and intent. The rules and procedures <br /> are adopted hereby and incorporated by reference herein and <br /> a copy of them shall be maintained in the office of the City <br /> Secretary.
