<br /> 2. Remedial measures instituted by the industrial user <br /> to correct the infraction; <br /> 3. violation history of the industrial user; <br /> 4. Potential for water quality degradation; and <br /> 5. Cooperativeness of the industrial user. <br /> (b) Upon the occurrence of a procedural violation under the <br /> ordinance, the director may either notify the industrial <br /> user of the infraction in writing by a letter of <br /> violation or in the alternative, immediately issue a <br /> citation for the infraction. If a letter of violation is <br /> sent it shall identify the infraction and specify a <br /> reasonable time in which the industrial user shall comply <br /> with the ordinance. If at the expiration of the stated <br /> time, compliance has not been achieved, the director <br /> shall issue a citation. <br /> (c) Upon the occurrence of an operational violation or a <br /> condition which in the opinion of the director could <br /> result in such an infraction, the director may follow any <br /> or all of the following escalating enforcement responses <br /> that the director deems appropriate, to-wit: <br /> step 1. Resolution of the matter through informal <br /> consultation, either orally or in writing, by <br /> development of a plan to achieve compliance. <br /> step 2. Send a letter of violation to the industrial <br /> user, certified mail, return receipt requested, <br /> identifying the nature of the violation and <br /> requiring a response from the industrial user <br /> within fifteen (15) days. <br /> *note: This step may be followed for a <br /> first violation, must be followed <br /> for a second violation and shall not <br /> be available for a third or <br /> subsequent violation relating to the <br /> same parameter in a permit. <br /> step 3. Issue a citation which may carry a fine and/or <br /> a compliance schedule specifying deadlines for <br /> proposing and initiating treatment technology <br /> needed to meet applicable limits. <br /> *note: Upon a third violation relating to <br /> the same parameter in a permit, this <br /> step is mandatory. <br /> 26 <br />
