<br /> or any order of the city, the city attorney may commence in action <br /> for appropriate legal and/or equitable relief in a court of <br /> competent jurisdiction. <br /> Enforcement Application. <br /> A continuing review of commercial water usage records and <br /> evaluation of wastewater sampling results, in conjunction with <br /> facility surveillance and inspections, will be practiced in <br /> identifying existing significant industrial users. <br /> A minimum of two unannounced facility inspections and a <br /> minimum of one sampling of wastewater discharges will be conducted <br /> by the control authority staff each year. Contractual analytical <br /> laboratory services, except for conventional pollutants, will be <br /> utilized in monitoring to assure permit compliance. Example forms <br /> for facility inspections and sampling are presented in Figures 1, <br /> 2, 3, and 4. <br /> Investigative response to all reports of industrial user non- <br /> compliance with the Ordinance, whether alleged or actual <br /> infractions, will be prompt. A written report will be prepared on <br /> facility inspection. An appropriate enforcement action, if such is <br /> warranted by inspection findings, will be initiated by the Director <br /> within five (5) workings days after receipt of evidence of <br /> violation occurrence. <br /> A display board, in conjunction with a computer calendar <br /> program, will be employed for tracking reporting requirement dates <br /> of industrial user permittees. status of compliance, operating <br /> performance, facility inspections, processes used, water usage and <br /> other aspects relative to permitted industrial liquid waste <br /> dischargers will be maintained in computer programs to facilitate <br /> rapid information retrieval. No set schedule will be created for <br /> facility inspections or for sampling of liquid waste discharges. <br /> thus precluding need for routine management information security. <br /> Permit compliance evaluation will be based upon routine self- <br /> reported waste discharge data required of the industrial user, as <br /> well as data from random sampling conducted by Control Authority <br /> staff. <br /> Penalties. <br /> I. Fines. <br /> A person who violates any provision of the ordinance or any <br /> order or permit issued under the Ordinance will be subject to a <br /> fine of not less than One Hundred Dollars ($100.00). The maximum <br /> fine may be as high as Ten Thousand Dollars ($10,000.00) or Twenty- <br /> Five Thousand Dollars ($25,000.00) depending upon the circumstances <br /> 29 <br />
