Special Warranty Deed <br />Date: <br />Grantor: City of San Marcos, Texas, a Texas municipal corporation. <br />Grantor's Mailing Address: 300 East. Hopkins Street, San Marcos, Hays County, Texas 78666 <br />Grantee: Texas State University -San Marcos <br />Grantee's Mailing Address: 601 University Drive, San Marcos, Hays County, Texas 78666 <br />Consideration: TEN DOLLARS ($10.00) and other good and valuable consideration, the <br />receipt and sufficiency of which are hereby acknowledged. <br />Property (including any improvements): Two segments of public right -of -way known as <br />Woods Street, consisting of approximately acres, as shown and described in Exhibit "A," <br />attached hereto and made a part hereof for all purposes. <br />Reservations from and Exceptions to Conveyance and Warranty: <br />1. Validly existing easements, and prescriptive rights; all presently recorded and validly <br />existing restrictions, reservations, covenants, conditions, oil and gas leases, mineral interests, and <br />water interests outstanding in persons other than Grantor, and other instruments that affect the <br />Property; validly existing rights of adjoining owners in any walls and fences situated on a <br />common boundary; any discrepancies, conflicts, or shortages in area or boundary lines; any <br />encroachments or overlapping of improvements. <br />2. Existing utilities, including the existing gas pipeline owned and operated by CenterPoint <br />Energy for which an easement is herein reserved, said easement being ten feet on either side of <br />the centerline of the existing gas pipeline, subject to any rights and privileges retained by <br />CenterPoint Energy under applicable state laws. <br />3. Grantor reserves for itself, its successors and assigns and the general public the <br />continuing free and uninterrupted right of access across the Property by any means lawfully <br />permitted on the public streets, roads and sidewalks in the City of San Marcos. Such right of <br />access shall not be limited or discouraged by Grantee by means such as controlled access gates, <br />roadblocks, checkpoints, security kiosks, time of day restrictions or signage suggesting that <br />access is limited only to Grantee's students, staff, faculty or visitors. Grantee agrees that it will <br />be responsible for maintaining the Property and that it will maintain the street and sidewalk <br />improvements at a level comparable or superior to City of San Marcos street and sidewalk <br />standards. The Property shall, otherwise, be subject to Grantee's rules and regulations and <br />criminal and administrative enforcement authority. <br />a. Temporary Interruptions of Public Access.
