<br />that the Contractor is entitled to payment in the amount certified. <br />However, the issuance of a Certificate for Payment shall not be a <br />representation that the ARCHITECT has made any examination to ascertain <br />how and for what purpose the Contractor has used the monies paid on <br />account of the Contract Sum. <br />1.3.10 The ARCHITECT shall have authority to reject work which does <br />not conform to the construction contract documents. Whenever, in the <br />ARCHITECT's reasonable opinion, it is necessary or advisable for the <br />proper implementation of the intent of the construction contract <br />documents, and with the approval of the CITY, the ARCHITECT will have <br />authority to require special inspection or testing of the work in <br />accordance with the provisions of the construction contract documents, <br />whether or not such work be then fabricated, installed or completed. <br />The ARCHITECT shall monitor and review the work and results of all <br />testing laboratories as required by the construction contract <br />documents. <br />1.3.11 The ARCHITECT shall review and make all decisions regarding <br />the approval or taking of other appropriate action upon the <br />Contractor's submittals, including but not limited to, Shop Drawings, <br />Product Data and Samples, Schedule of Values and progress schedule. <br />Such action shall be taken with reasonable promptness, but generally <br />not to exceed fifteen (15) days or such period of time which will not <br />cause delay of the Project. <br />1.3.12 The ARCHITECT shall prepare Change Orders in triplicate <br />originals for the CITY's approval and execution in accordance with the <br />construction contract documents, but shall not issue change orders not <br />previously approved in writing by CITY, and no course of conduct on the <br />part of ARCHITECT or CITY shall act to amend, waive or alter this <br />provision. <br />1.3.13 The ARCHITECT shall conduct professional inspections to <br />determine the Dates of Substantial Completion and final completion for <br />the Project, to evaluate the work for acceptable conformance with the <br />construction contract documents and in light of any subsequent tests <br />performed as described in Section 1.3.9 hereof, to verify that any <br />minor deviations from the construction contract documents as described <br />in Section 1. 3.9 hereof have been corrected and that the reasons for <br />any specific qualifications in any and all previous Certificates For <br /> <br />-9- <br />
