<br /> § 36-11 SAN MARCOS CODE § 36-12 <br /> SeC. 36-11. Inspection. <br /> (a) In order to protect the health, safety, and general welfare of <br /> the public, the holder of an approved subdivision plat or building <br /> permit within the SMRC shall permit duly authorized inspectors <br /> of the City of San Marcos, Texas, during reasonable hours to <br /> enter onto the land, tract, parcel or lot for which the approval <br /> was given for the purpose of determining compliance with the <br /> requirements of this chapter. Such approval is presumed when a <br /> person files an application under this chapter. <br /> (b) The City of San Marcos shall cause such inspections to be <br /> made of the land or premises during development and construc- <br /> tion so as to assure full compliance with all terms, conditions and <br /> requirements of this chapter. <br /> (c) The applicant shall designate one person or legal entity, <br /> with a current address, to which notice shall be given pursuant to <br /> this chapter. (Ord. No. 1985-79, § 1(11),8-1-85) <br /> Sec. 36-12. Drainage improvements maintenance criteria. <br /> All development of land required to comply with the terms of <br /> this chapter shall meet these requirements: <br /> (1) All drainage -improvements, contaminant removal facili- <br /> ties, and detention basins located in public rights-of-way or <br /> publicly dedicated easements that have been accepted by <br /> the city for maintenance shall be maintained by the city. <br /> (2) All drainage improvements, contaminant removal facili- <br /> ties, detention basins located on private property and other <br /> publicly dedicated easements not accepted by the city for <br /> maintenance shall be maintained by the property owner. <br /> (3) Duly authorized inspectors of the city may lawfully enter <br /> onto the land or premises where property owners are re- <br /> quired to maintain facilities, as required by this chapter, <br /> at reasonable times, for the purpose of inspection of the <br /> maintenance required. The director, or his designated rep- <br /> resentative, shall inspect the premises of each such facility <br /> approved pursuant to this chapter at least once per year. <br /> Where noncompliance is found, the city shall request in <br /> Supp. No. 22 1060.154 <br /> ~ <br />
