<br /> easements and their respective water lines. <br /> AGREEMENT <br /> NOW THEREFORE, for and in consideration of the premises <br /> and the mutual covenants and promises contained herein, San <br /> Marcos and Maxwell agree as follows: <br /> I. <br /> COMPLIANCE WITH REGULATIONS <br /> 1.01. Maxwell and San Marcos will comply with all <br /> regulations of any regulatory authority having jurisdiction, <br /> including but not limited to the Texas Water Commission and the <br /> Texas Department of Health, governing the operation and <br /> maintenance of water lines and the relative location of water <br /> and sewer lines. <br /> II. <br /> NEW CONSTRUCTION <br /> 2.01. Plans for New Construction. If either party <br /> <br /> undertakes new construction within its easement, that party will <br /> show the location of all utility lines in both easements and <br /> will include this location within the plans for new <br /> construction. The party undertaking new construction will <br /> provide to the other party one set of plans and specifications <br /> at least fifteen (15) days prior to the finalization of the <br /> plans and specifications. The party undertaking the new <br /> construction will use good faith efforts to incorporate the <br /> suggestions of the other party in the final plans and <br /> -2- <br />
