<br /> specifications. <br /> 2.02. Commencement of Construction Activities. The party <br /> undertaking construction will provide the other party at least <br /> ten (lO) days written notice prior to the commencement of <br /> construction. <br /> III. <br /> REPAIR, BACKFILL, AND RESTORATION OF SURFACE <br /> 3.01. Repair of Lines. In the event either party, its <br /> <br /> agent or contractor, damages the line of the other party, the <br /> party whose agent or contractor caused the damage shall promptly <br /> repair the line, the repair to be effected in compliance with <br /> the American Waterworks Specifications, the Uniform Plumbing <br /> Code, and any applicable local codes or regulatory requirements, <br /> latest edition. In the event of conflicting regulations, the <br /> more stringent shall apply. <br /> 3.02. Backfill. Backfill of any excavation work for new <br /> construction, maintenance or repair, shall comply with the <br /> applicable paragraphs of Item 401, Excavation for Pipes Sewers, <br /> of the Texas state Department of Highways and Public <br /> Transportation Standard Specifications, latest edition. <br /> 3.03. Restoration of Surface. The party doing new <br /> construction, maintenance, or repairs, shall restore the surface <br /> of the ground to its condition prior to entry in so far as <br /> practicable. <br /> -3- <br />
