<br /> III <br />The Parties agree that the Edwards Underground Water <br />District will serve as the contracting and <br />coordinating agency for the Study. The Edwards <br />Underground Water District is authorized to accept, <br />hold and disburse funds for the Study. <br /> IV <br />The Edwards Underground Water District will fund the <br />development of the basic computer hydrology model by <br />the Consultant and all work related to recharge <br />enhancement. The City of San Marcos and the City of <br />Corpus Christi will fund the particular tasks <br />included in the scope of work to be negotiated with <br />the Consultant necessary to answer their specific <br />questions about the availability of surface water for <br />their needs. The Parties understand that the City of <br />San Marcos and the City of Corpus Christi will fix <br />their funding amount at the time the final scope of <br />work is prepared according to the tasks that each <br />includes. The City of San Marcos reserves the right <br />to elect not to participate in funding for the Study <br />once the funding amounts are fixed. In such event, <br />the scope of work will be changed to remove tasks <br />particular to the City of San Marcos. Payments to <br />Edwards Underground Water District by the other <br />Parties will be made in a timely manner so that funds <br />will be available when needed to meet the <br />Consultant's payment schedule. <br /> V <br />The Parties hereto agcee that the Consultant <br />selected, his employees and subcontractors, will be <br />independent contractors and not employees of any of <br />the Parties hereto. A contract with the Consultant <br />for the Study will be subject to approval by each of <br />the Parties. <br /> VI <br />The Study Report and any data or product of such <br />data will be the joint property of all the Parties <br />hereto and any party may utilize such report and <br />data and product of such data in any manner deemed <br />necessary at that Party's sole discretion. Until <br />the Study Report is complete, the Parties must <br />unanimously agree to the release of any information <br />to the public. <br />
