<br />of <br /> <br />the <br /> <br />additive <br /> <br />change <br /> <br />order <br /> <br />but <br /> <br />only <br /> <br />to <br /> <br />the <br /> <br />extent <br /> <br />that <br /> <br />the <br /> <br />cumulative <br /> <br />total <br /> <br />of <br /> <br />such change orders exceeds three percent (3%) of <br /> <br />the construction cost. <br /> <br />1.3.14 <br /> <br />The Engineer shall conduct on-site professional observations <br /> <br />to <br /> <br />determine the Dates of Substantial Completion and final completion, <br /> <br />to <br /> <br />evaluate <br /> <br />the Work for acceptable conformance with the construction <br /> <br />contract <br /> <br />documents <br /> <br />and <br /> <br />in light of any subsequent tests performed as <br /> <br />described <br /> <br />in <br /> <br />Section <br /> <br />1.3.10 <br /> <br />hereof, <br /> <br />to <br /> <br />verify <br /> <br />that <br /> <br />any <br /> <br />minor <br /> <br />deviations <br /> <br />from <br /> <br />the <br /> <br />construction <br /> <br />contract documents as described in <br /> <br />Section <br /> <br />1.3.10 hereof have been corrected and that the reasons for any <br /> <br />specific <br /> <br />qualifications <br /> <br />in <br /> <br />previous <br /> <br />Certificates <br /> <br />For <br /> <br />Payment <br /> <br />as <br /> <br />described <br /> <br />in <br /> <br />Section. 1.3.10 hereof are either no longer valid or the <br /> <br />condition(s) <br /> <br />and/or <br /> <br />problem(s) <br /> <br />have <br /> <br />been <br /> <br />corrected; shall receive, <br /> <br />assemble, <br /> <br />and review written warranties and related documents required <br /> <br />by <br /> <br />the <br /> <br />construction <br /> <br />contract <br /> <br />documents; shall provide operation and <br /> <br />maintenance <br /> <br />instruction and up to one (1) day training for the Owner's <br /> <br />operations <br /> <br />personnel; <br /> <br />shall <br /> <br />conduct, <br /> <br />in company with Owner, a final <br /> <br />observation <br /> <br />and <br /> <br />evaluation <br /> <br />of <br /> <br />the <br /> <br />project <br /> <br />for compliance with the <br /> <br />construction <br /> <br />contract <br /> <br />documents! <br /> <br />and shall issue a final Certificate <br /> <br />for <br /> <br />Payment or take other appropriate action; and shall make a written <br /> <br />recommendation to Owner regarding Owner's acceptance of the Project. <br /> <br />1.3.15 <br /> <br />The <br /> <br />extent <br /> <br />of the duties, responsibilities and limitations <br /> <br />of <br /> <br />authority <br /> <br />of <br /> <br />the <br /> <br />Engineer <br /> <br />as <br /> <br />the Owner's representative during <br /> <br />construction <br /> <br />shall <br /> <br />not be modified or extended after the construction <br /> <br />contract <br /> <br />documents <br /> <br />have <br /> <br />been authorized by Owner to be competitively <br /> <br />bid <br /> <br />without <br /> <br />written <br /> <br />consent <br /> <br />of <br /> <br />the Owner and the Engineer and with <br /> <br />notice to the Contractor. <br /> <br />-9- <br />
