<br />proposals <br /> <br />from contractors except costs incident to the preparation of <br /> <br />the <br /> <br />final <br /> <br />construction <br /> <br />documents <br /> <br />under Section 1.2 above. <br /> <br />Further, <br /> <br />Owner <br /> <br />shall assume responsibility for the distribution of construction <br /> <br />contract documents to potential bidders. <br /> <br />2.9 <br /> <br />The <br /> <br />Owner <br /> <br />shall <br /> <br />either direct the Engineer to perform any <br /> <br />and <br /> <br />all <br /> <br />Additional Service necessary to complete the project or shall <br /> <br />furnish such services itself. <br /> <br />2.10 <br /> <br />The <br /> <br />Owner <br /> <br />shall <br /> <br />pay <br /> <br />all <br /> <br />fees <br /> <br />for filing and processing <br /> <br />permits in connection with the project. <br /> <br />2.11 <br /> <br />The Owner shall bear all costs incident to this Article. <br /> <br />2.12 <br /> <br />Owner <br /> <br />shall <br /> <br />provide <br /> <br />its <br /> <br />form <br /> <br />of <br /> <br />standard <br /> <br />construction <br /> <br />contract <br /> <br />documents <br /> <br />which <br /> <br />do <br /> <br />not <br /> <br />include <br /> <br />plans <br /> <br />or <br /> <br />technical <br /> <br />specifications, <br /> <br />to <br /> <br />the <br /> <br />Engineer <br /> <br />prior to commencement of the design <br /> <br />phase, Section 1.2. <br /> <br />2.13 <br /> <br />Owner <br /> <br />shall <br /> <br />provide the Engineer with the accounting basis <br /> <br />for billing acceptable to the Owner. <br /> <br />ARTICLE 3 <br /> <br />CONSTRUCTION COST <br /> <br />3.1 RESPONSIBILITY FOR CONSTRUCTION COST <br /> <br />3.1.1 <br /> <br />Evaluations <br /> <br />of the Owner's Project budget and detailed cost <br /> <br />estimates, <br /> <br />if <br /> <br />any, prepared by the Engineer, represent the Engineer's <br /> <br />best <br /> <br />judgement as a design professional familiar with the construction <br /> <br />industry. <br /> <br />3.1. 2 <br /> <br />In <br /> <br />providing opinions of cost, financial analyses, economic <br /> <br />feasibility <br /> <br />projections, <br /> <br />and <br /> <br />schedules for the project, the Engineer <br /> <br />has <br /> <br />no <br /> <br />control <br /> <br />over cost or price of labor and materials; unknown or <br /> <br />latent <br /> <br />conditions <br /> <br />or existing equipment or structures that may affect <br /> <br />-13- <br />
