<br />II <br /> <br />This AGREEMENT is made this the <br /> <br />9 <br /> <br />day of <br /> <br />January <br /> <br />19 gO <br /> <br />between the CITY OF SAN MARCOS, TEXAS, hereinafter referred to <br /> <br />as "OWNER', 630 East Hopkins, San Marcos, Texas 78666, <br /> <br />and <br /> <br />CH2M <br /> <br />Hill, <br /> <br />Inc. , <br /> <br />3410 <br /> <br />Far <br /> <br />West <br /> <br />Blvd., <br /> <br />Suite 200, Austin, TX <br /> <br />78731, <br /> <br />hereinafter referred to as "ENGINEER", for engineering services <br /> <br />in <br /> <br />connection <br /> <br />with <br /> <br />the <br /> <br />East <br /> <br />Side <br /> <br />Wastewater <br /> <br />Interceptor <br /> <br />River <br /> <br />Crossing. <br /> <br />WITNESSETH: <br /> <br />Owner and Engineer do hereby agree as follows: <br /> <br />ARTICLE 1 <br /> <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br /> <br />Engineer <br /> <br />shall <br /> <br />be <br /> <br />responsible <br /> <br />for <br /> <br />the <br /> <br />proper, <br /> <br />accurate <br /> <br />and <br /> <br />adequate <br /> <br />design <br /> <br />of <br /> <br />the <br /> <br />East <br /> <br />Side Wastewater Interceptor River <br /> <br />Crossing <br /> <br />as <br /> <br />well <br /> <br />as <br /> <br />the <br /> <br />preparation <br /> <br />of accurate and adequate <br /> <br />plans, <br /> <br />specifications, <br /> <br />reports <br /> <br />and <br /> <br />other construction contract <br /> <br />documents <br /> <br />for <br /> <br />the <br /> <br />project, and any provisions in this Agreement <br /> <br />pertaining <br /> <br />to <br /> <br />Owner's <br /> <br />review, <br /> <br />approval <br /> <br />and/or <br /> <br />acceptance <br /> <br />of <br /> <br />reports, <br /> <br />plans, <br /> <br />specifications, construction contract documents, <br /> <br />or <br /> <br />other <br /> <br />written <br /> <br />materials <br /> <br />prepared <br /> <br />by <br /> <br />Engineer <br /> <br />or <br /> <br />its <br /> <br />consultants, <br /> <br />contractors, <br /> <br />and <br /> <br />subcontractors in connection with <br /> <br />this <br /> <br />project <br /> <br />shall <br /> <br />not <br /> <br />be <br /> <br />deemed <br /> <br />to <br /> <br />diminish <br /> <br />Enginee-r' s <br /> <br />responsibility <br /> <br />therefor. The Engineer's Basic Services consist of <br /> <br />the <br /> <br />following <br /> <br />phases <br /> <br />described <br /> <br />in Sections 1.1 through 1.3 and <br /> <br />include <br /> <br />normal <br /> <br />civil, <br /> <br />structural, <br /> <br />mechanical <br /> <br />and <br /> <br />electrical <br /> <br />engineering services. <br /> <br />-1- <br />
