<br />F. <br /> <br />-11- <br /> <br />8. i), 17 <br />J (: I <br /> <br />(ll\t) <br />ì" Ii., " ' <br />\J h " <br /> <br />then the amount paid under this paragraph shall be considered <br /> <br />a collection of sales taxes for the purpose of determining <br /> <br />compliance with Section II (C) <br /> <br />in subsequent years of this <br /> <br />Agreement. <br /> <br />If the City declares that Factory Stores is in default with <br /> <br />respect to this Agreement and thereafter the City terminates <br /> <br />this Agreement, in whole or in part, Factory Stores agrees to <br /> <br />pay to the City the value of all fee waivers provided for in <br /> <br />Section <br /> <br />below, <br /> <br />provided, <br /> <br />that <br /> <br />this <br /> <br />VI, <br /> <br />shall <br /> <br />be <br /> <br />amount <br /> <br />reduced by twenty percent (20%) for each full calendar year, <br /> <br />starting with 1991, <br /> <br />in which Factory Stores fully performs <br /> <br />its obligations under this Agreement. <br /> <br />Factory Stores agrees <br /> <br />to make this payment in full within sixty (60) days of its <br /> <br />receipt of a written statement from the City which itemizes <br /> <br />these <br /> <br />fees <br /> <br />and <br /> <br />incorporates <br /> <br />reductions <br /> <br />as <br /> <br />provided <br /> <br />any <br /> <br />above. <br /> <br />Factory Stores further agrees that, should it fail to <br /> <br />remit full payment of this amount within that time, then the <br /> <br />City is expressly authorized to have a copy of the itemized <br /> <br />statement executed by the City Manager of the City recorded <br /> <br />in the real property records of Hays County, Texas, as a lien <br /> <br />against the Property. <br /> <br />Provided, that in the event of a bona <br /> <br />fide dispute between the City and Factory Stores regarding <br /> <br />default, if Factory Stores deposits with the City a bond in <br /> <br />the amount of, or other reasonable security for, the fees due <br /> <br />pursuant to this Section V (F), the City shall not record a <br /> <br />lien against the Property to secure the payment of such fees~ <br /> <br />G. <br /> <br />Factory Stores expressly acknowledges and agrees <br /> <br />tha t the <br /> <br />amount of taxes abated each year under the terms of this <br />
