<br />815 <br /> <br />188 <br /> <br />lowering, or the encasing of any such pipelines within ninety (90) <br /> <br />days after receipt of a written request for such work. <br /> <br />(10) The 1.77 Acre Permanent Easement shall be used solely to <br /> <br />construct, <br /> <br />maintain, <br /> <br />repair, <br /> <br />and operate a <br /> <br />first-class, <br /> <br />paved <br /> <br />roadway and necessary drainage for the roadway. <br /> <br />The City shall <br /> <br />have no right to use or to allow the use of the area included <br /> <br />within the 1.77 Acre Permanent Easement for any other purpose than <br /> <br />a paved <br /> <br />roadway <br /> <br />including, <br /> <br />but <br /> <br />not <br /> <br />limited <br /> <br />to, <br /> <br />use <br /> <br />for the <br /> <br />construction and operation of any type of pipeline, powerline, <br /> <br />telephone or telecommunications line; provided that upon thirty <br /> <br />(30) days advance written notice by the City to the Reasoners, the <br /> <br />City shall have the right to temporarily use of the area within the <br /> <br />1.77 acre Permanent Easement for a period not to exceed 160 days <br /> <br />(the <br /> <br />"Initial <br /> <br />Construction <br /> <br />Period" ) <br /> <br />in <br /> <br />connection <br /> <br />with <br /> <br />the <br /> <br />construction of the water pipeline described in Paragraph 4 above <br /> <br />within the 1.15 acre Permanent Easement. <br /> <br />(11) The <br /> <br />City <br /> <br />agrees <br /> <br />to <br /> <br />submit <br /> <br />a <br /> <br />request <br /> <br />to <br /> <br />the <br /> <br />Texas <br /> <br />Department of Highways and Public Trnasportation ("TDHPT") for the <br /> <br />roadway to be constructed and maintained to tie into existing <br /> <br />driveways <br /> <br />on <br /> <br />the <br /> <br />Reasoner <br /> <br />Tract <br /> <br />to <br /> <br />meet <br /> <br />generally <br /> <br />accepted <br /> <br />engineering <br /> <br />standards, <br /> <br />or <br /> <br />if <br /> <br />no <br /> <br />driveways <br /> <br />exist <br /> <br />at <br /> <br />time <br /> <br />of <br /> <br />construction, for the provision of up to four curb cuts, a minimum <br /> <br />of thirty-five feet in width to access the Reasoner Tract at <br /> <br />locations designated by the Reasoners and constructed in accordance <br /> <br />with generally accepted engineering standards. <br /> <br />-5- <br />
