<br />815 <br /> <br />187 <br /> <br />(5) <br /> <br />In no event shall the depth of the pipelines within the <br /> <br />1.15 Acre Permanent Easement have a solid ground cover over them <br /> <br />of less than forty-two inches (42"). <br /> <br />(6) <br /> <br />The City agrees to return and to maintain the soil <br /> <br />profile of the ground within the bounds of the 1.15 Acre Permanent <br /> <br />Easement and Temporary Easements so that it will be the same as <br /> <br />existed before the construction of the pipelines within the 1.15 <br /> <br />Acre Permanent Easement. <br /> <br />(7) <br /> <br />The City agrees to double ditch the area where soil is <br /> <br />removed within the 1.15 Acre Permanent Easement so that the topsoil <br /> <br />will be segregated from the subsoil during the ditching operation, <br /> <br />and the subsoil first returned to the ditch after the pipelines are <br /> <br />laid, then the topsoil returned so that the topsoil will remain <br /> <br />separated from the subsoil and returned to its original position. <br /> <br />(8) <br /> <br />The construction of the sanitary sewerage pipeline within <br /> <br />the 1.15 Acre Permanent Easement shall be completed within 160 days <br /> <br />after the City executes this Agreement (the "Initial Construction <br /> <br />Period") . <br /> <br />(9) <br /> <br />If it is ever necessary during the term of this Agreement <br /> <br />to lower or to encase any pipeline or pipelines placed within the <br /> <br />1.15 Acre Permanent Easement to allow for the construction and <br /> <br />operation of any roads or driveways (as well as drainage associated <br /> <br />therewith) <br /> <br />to access any part of the Reasoner Tract, the City <br /> <br />agrees at its expense to lower, or to encase, or to cause the <br /> <br />-4- <br />
