<br />815 <br /> <br />186 <br /> <br />The easements are shown on the plat attached to this Agreement on <br /> <br />Exhibit "D". <br /> <br />(2) <br /> <br />The City shall have no right, title or interest of any <br /> <br />kind or character whatsoever in or to any of the Reasoner Tract, <br /> <br />whether real or personal, outside the bounds of the Permanent and <br /> <br />Temporary Easements, nor shall it have any aerial rights on any <br /> <br />part of the Reasoner Tract, whether inside or outside the bounds <br /> <br />of the Permanent or Temporary Easements. <br /> <br />(3) <br /> <br />The <br /> <br />Temporary <br /> <br />Easements <br /> <br />shall <br /> <br />be <br /> <br />used <br /> <br />solely <br /> <br />in <br /> <br />connection with the construction of the water pipeline and the <br /> <br />sanitary sewerage pipeline within the 1.15 Acre Permanent Easement. <br /> <br />The <br /> <br />Temporary <br /> <br />Easements <br /> <br />shall <br /> <br />expire <br /> <br />and <br /> <br />all <br /> <br />rights <br /> <br />therein <br /> <br />automatically revert to the Reasoners free and clear of any right, <br /> <br />title or interest in the City 160 days after the effective date of <br /> <br />this Agreement. <br /> <br />PURPOSES AND USES OF PERMANENT AND TEMPORARY EASEMENTS <br /> <br />(4) <br /> <br />The 1.15 Acre Permanent Easement shall be used solely to <br /> <br />construct, maintain, and operate (a) one water pipeline (including <br /> <br />connecting pipelines to serve all parts of the Reasoner Tract) for <br /> <br />the transmission and distribution of water; and (b) one sanitary <br /> <br />sewerage pipeline <br /> <br />(including connecting pipelines to serve all <br /> <br />parts of the Reasoner Tract). <br /> <br />-3- <br />
