<br />815 <br /> <br />185 <br /> <br />is subj ect to all other easements, <br /> <br />leases, and encumbrances of <br /> <br />record or which the City has actual knowledge as of the time the <br />City Manager signs this Agreement. <br /> <br />The Reasoners for Ten and No/100 Dollars ($10.00) and other <br /> <br />good and valuable consideration stated in this Agreement do hereby <br /> <br />grant, sell and convey to the City two separate and distinct non- <br /> <br />exclusive, permanent easements and rights-of-way and two temporary <br /> <br />easements and rights-of-way to have and to hold so long as the <br /> <br />easements and rights-of-way shall be used in strict accordance with <br /> <br />the terms, conditions, limitations and exceptions in this Agreement <br /> <br />as set forth below. <br /> <br />( 1) <br /> <br />DESCRIPTION OF PERMANENT AND TEMPORARY EASEMENTS <br /> <br />way and the two temporary easements and rights-of-way are described <br /> <br />The two non-exclusive permanent easements and rights-of- <br /> <br />as follows: <br /> <br />( a) <br /> <br />(b) <br /> <br />(c) <br /> <br />a 1.15 acre tract, more or less, situated in the J. M. <br />Veramendi League No.2, Hays County, Texas, which is more <br />particularly described on Exhibit "A", attached to this <br />Agreement (the "1.77 Acre Permanent Easement" and the <br />"1. 77 Acre Temporary Easement "); and <br /> <br />a 1.80 acre tract, more or less, situated in the J. M. <br />Veramendi League No.2, Hays County, Texas, which is more <br />particularly described in Exhibit "C", attached to this <br />Agreement (the "1.80 Acre Temporary Easement"). <br /> <br />-2- <br />
