<br /> <br /> <br />~ <br />c::::s- <br />-- <br /> <br /> <br />52 <br /> <br />ORDINANCE 1990-8 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, ORDERING A JOINT GENERAL <br />AND SPECIAL ELECTION BY SAID CITY AND THE SAN <br />MARCOS CONSOLIDATED INDEPENDENT SCHOOL <br />DISTRICT TO BE HELD IN THE CITY OF SAN MARCOS, <br />TEXAS ON MAY 5, 1990 FOR THE PURPOSE OF <br />ELECTING A MAYOR, A CITY COUNCIL MEMBER, <br />PLACE THREE, AND A CITY COUNCIL MEMBER, PLACE <br />FOUR, AND FOR THE PURPOSE OF SUBMITTING TO THE <br />VOTERS PROPOSED AMENDMENTS TO THE CITY CHARTER <br />AND SUBMITTING TO THE VOTERS A PROPOSAL FOR <br />RENEWAL OF A LEASE OF CITY PARK PROPERTY TO <br />THE SAN MARCOS LIONS CLUB; AND TO BE HELD <br />WITHIN THE BOUNDARIES OF SAID SCHOOL DISTRICT <br />FOR THE PURPOSE OF ELECTING A SCHOOL DISTRICT <br />BOARD OF TRUSTEES MEMBER, PLACE FIVE, A <br />SCHOOL DISTRICT BOARD OF TRUSTEES MEMBER, <br />PLACE SIX AND A SCHOOL DISTRICT BOARD OF <br />TRUSTEES MEMBER FOR PLACE SEVEN; ESTABLISHING <br />THE RATE OF COMPENSATION TO BE PAID JUDGES, <br />CLERKS, AND ASSISTANTS TO THE TABULATION <br />SUPERVISOR FOR SERVICES RENDERED DURING SAID <br />ELECTION; MAKING PROVISIONS FOR THE CONDUCT OF <br />THE ELECTION AND OTHER PROVISIONS INCIDENT TO <br />THE PURPOSES OF THIS ORDINANCE; AND DECLARING <br />AN EMERGENCY. <br /> <br />Î'" <br /> <br />~ <br />I,,;S'""' <br />..;s- <br /> <br /> <br />i'i'.. <br /> <br /><"'"" <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That, in accordance with the Charter of the <br />City of San Marcos and the laws of the State of Texas, so far as <br />the same may be applicable, a joint general and special election <br />is ordered to be held by the City of San Marcos, Texas and the San <br />Marcos Consolidated Independent School District, at the various <br />polling places and election precincts within the corporate limits <br />of the City of San Marcos, Texas, and within the boundaries of the <br />San Marcos Consolidated Independent School District, as <br />hereinafter designated, on the 5th day of May, 1990, from the <br />hours of 7 :00 a.m. to 7 :00 p.m., at which joint election there <br />shall be elected by the qualified voters of the City of San Marcos <br />from the City at large, a City Council Member for Place Three <br />and a City Council Member for Place Four, for terms of three years <br />each and a: Mayor for a term of two years and at which joint <br />election there shall be submitted to the qualified voters of the <br />City proposed amendments to the City Charter of San Marcos, and a <br />proposed renewal of a lease of City park property to the San <br />Marcos Lions Club. By the qualified voters of the San Marcos <br />Consolidated Independent School District there shall be elected a <br />School District Board of Trustees Member for Place Five, and a <br />School District Board of Trustees Member for Place Six and a <br />School District Board of Trustees Member for Place Seven, for <br />terms of three years each. <br /> <br />SECTION 2. That, in accordance with Section 9.004 of the <br />Texas Local Government Code, and Sections 3.07(a), 12.11 and 12.12 <br />of the City Charter, and with other applicable laws, the following <br />measures shall be submitted to the qualified voters of the City at <br />the election to be held May 5, 1990: <br /> <br />MEASURE NO. ONE <br />SHALL SECTION 3.06 OF THE CITY CHARTER BFA¥,k'1\:rryFD TO READ AS <br />FOLLOWS: <br /> <br />Sec. 3.06. <br /> <br />Vacancies. <br /> <br />(a) <br /> <br />A special election to fill a vacancy shall be called in <br />accordance with the Texas Election Code. In the event <br />the mayor is unable to order the election for any <br />reason, the remaining members of the city council are <br />authorized and directed to order the election and <br />perform all other required actions incident to the <br />election. In the event of vacancies in the offices of <br />mayor and all members of the city council for any <br />reason, the following persons, in the order prescribed, <br />
