<br />65 <br /> <br />AGREEMENT FOR THE PROVISION AND MAINTENANCE <br />OF BENCHES IN THE CITY OF SAN MARCOS <br /> <br />THE STATE OF TEXAS <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br /> <br />COUNTY OF HAYS <br /> <br />That <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />San <br /> <br />Marcos, <br /> <br />Texas, <br /> <br />a <br /> <br />Texas <br /> <br />municipal <br /> <br />corporation <br /> <br />located <br /> <br />in <br /> <br />Hays <br /> <br />and <br /> <br />Caldwell <br /> <br />Counties, <br /> <br />Texas, <br /> <br />hereinafter referred to as City, and Sign Crafters, each acting <br /> <br />through its duly authorized representative, hereby enter into this <br /> <br />agreement; the terms, conditions and considerations for which are <br /> <br />set out as follows: <br /> <br />City <br /> <br />agrees <br /> <br /> I. <br />to allow Sign Crafters to utilize City <br />the location of benches for the use and <br /> <br />right-of-way <br /> <br />for <br /> <br />convenience of the public. <br /> <br />II. <br /> <br />The <br /> <br />term of <br /> <br />this <br /> <br />agreement <br /> <br />shall <br /> <br />be <br /> <br />for <br /> <br />five <br /> <br />(5 ) <br /> <br />years <br /> <br />beginning January 1, 1990. <br /> <br />The obligation to make the last annual <br /> <br />payment due under Section III, however, shall survive the term of <br /> <br />this agreement and this payment shall be due on or before March I, <br /> <br />1995. <br /> <br />III. <br /> <br />Sign Crafters agrees to pay the City a fixed sum of Ten and <br />no/100 ($10.00) Dollars annually for such right, and in addition, <br /> <br />Sign Crafters agrees to pay to the City an annual sum equal to <br /> <br />five per cent (5%) of the gross receipts received by Sign Crafters <br /> <br />during <br /> <br />each <br /> <br />calendar year <br /> <br />of <br /> <br />this <br /> <br />agreement <br /> <br />from <br /> <br />advertising <br />
