<br />-2- <br /> <br />appearing on the benches, <br /> <br />This annual payment shall be made on or <br /> <br />before March 1 of the year following each respective calendar year <br /> <br />during the term of this agreement. <br /> <br />IV. <br /> <br />Sign <br /> <br />Crafters <br /> <br />agrees <br /> <br />to maintain <br /> <br />financial <br /> <br />records <br /> <br />which <br /> <br />sufficiently satisfy City requirements and to furnish certified <br /> <br />statements of total gross receipts derived from advertising on its <br /> <br />benches upon request of City, <br /> <br />v. <br /> <br />Sign Crafters agrees to maintain benches within the City of <br /> <br />San Marcos <br /> <br />at the <br /> <br />locations <br /> <br />shown on the attached Exhibit A, <br /> <br />incorporated herein for all purposes. <br /> <br />Should Sign Crafters wish <br /> <br />to add or delete any location from this agreement Sign Crafters <br /> <br />shall deliver to the City Manager an amended map seven (7) days <br /> <br />prior to the date on which the proposed addition or deletion will <br /> <br />become effective. Within this seven ( 7) day period, the City <br />Manager shall give written approval or disapproval or shall <br />request in writing further time for consideration of the <br /> <br />amendment. <br /> <br />Should the City Manager fail to take action within the <br /> <br />seven (7) day period, Sign Crafters may proceed with the proposed <br /> <br />amendment, <br /> <br />Notwithstanding any other provision of this agreement, <br /> <br />Sign Crafters agrees to remove or relocate any bench within thirty <br /> <br />(30) <br /> <br />days <br /> <br />of <br /> <br />its <br /> <br />receipt of <br /> <br />a written request of City or an <br /> <br />adjacent property owner. <br /> <br />VI. <br /> <br />Sign <br /> <br />Crafters <br /> <br />agrees <br /> <br />that <br /> <br />all <br /> <br />benches <br /> <br />shall <br /> <br />be <br /> <br />securely <br /> <br />constructed of concrete and wood and/or plastic in a safe manner. <br />
