l32 Regular Meeting Septerr.ber 26, 1983 Page 4 Mayor Craddock introduced for consideration the adoption of an Ordin- ance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE II OF CHAPTER 26 OF THE CODE OF ORDINANCES OF SAID CITY TO DEFINE TERMS; TO INCREASE FROM FOUR PERCENT (4%) TO SEVEN PERCENT (7%) THE TAX UPON THE COST OF OCCUPANCY OF ANY SLEEPING ROOM FURNISHED BY ANY HOTEL IN SAID CITY WHERE THE COST OF OCCUPANCY IS AT THE RATE OF TWO DOLLARS ($ 2) OR MORE PER DAY; TO PROVIDE THAT ANY REVENUES FROM A TAX IN EXCESS OF FOUR PERCENT (4%) OF THE CONSIDERATION PAID BY AN OCCUPANT OF THE SLEEPING ROOM TO THE HOTEL MAY ONLY BE USED FOR CONVENTION CENTER IMPROVEMENTS, FACILITIES AND PERSONNEL FOR THE REGISTRATION OF CONVENTIONEERS AND ADVERTISING AND PROMOTING THE CITY; TO PROVIDE THAT NO MORE THAN ONE PERCENT (1%) OF THE CONSIDERA- TION PAID BY SUCH AN OCCUPANT MAY BE USED FOR THE ENCOURAGEMENT, PROMOTION, IMPROVEMENTS AND APPLICA- TION OF THE ARTS; TO AUTHORIZE ENFORCEMENT ACTIONS BY SAID CITY TO CLOSE DOWN HOTELS DELINQUENT IN THE PAYMENT OF SAID TAX AND DECLARING AN EFFECTIVE DATE. Mr. Guerra moved for adoption of the Ordinance on third and final reading and Mr. Moore seconded the motion. Mr. Brown then moved the Ordinance be amended to be adopted on emergency rather than third and final reading so that the effective date could be after publica- tion in a newspaper of general circulation instead of ten days after adoption of the Ordinance, and that the effective date of the Ordin- ance be October 1, 1983. Mr. Farr seconded the amendment. Mr. Brown then moved to amend the Ordinance to be increased two cents rather than three cents and Mr. Farr seconded the motion. Mr. Brown said he had met with interested hotel persons and that a feasibility study is being prepared through the Chamber of Commerce and that the three cent increase may not be needed. On roll call of the amendment to increase 2 cents rather than 3 cents, the following vote was recorded: AYE: Brown, Farr. NAY: Guerra, Craddock, Kissler, Kreczmer, Moore. ABSTAIN: None. The motion failed. The Council then unanimously adopted the Ordinance on emergency with the effective date to be October 1, 1983. Mayor Craddock introduced for consideration the adoption of an Ordin- ance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS AND LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY CHANGING THE ZONING OF LOT NOS. 121 AND 122, IN BLOCK NO. 12, WESTOVER ADDITION, A/K/A 1408 AND 1410 EARLE, RESPECTIVELY, FROM IIR-l" (SINGLE-FAMILY DWELLING DISTRICT) TO IIR-2" (DUPLEX OR TWO-FAMILY DWELLING DISTRICT).
