<br /> l32 <br /> Regular Meeting Septerr.ber 26, 1983 Page 4 <br /> Mayor Craddock introduced for consideration the adoption of an Ordin- <br /> ance on third and final reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, <br /> AMENDING ARTICLE II OF CHAPTER 26 OF THE CODE <br /> OF ORDINANCES OF SAID CITY TO DEFINE TERMS; TO <br /> INCREASE FROM FOUR PERCENT (4%) TO SEVEN PERCENT <br /> (7%) THE TAX UPON THE COST OF OCCUPANCY OF ANY <br /> SLEEPING ROOM FURNISHED BY ANY HOTEL IN SAID CITY <br /> WHERE THE COST OF OCCUPANCY IS AT THE RATE OF TWO <br /> DOLLARS ($ 2) OR MORE PER DAY; TO PROVIDE THAT ANY <br /> REVENUES FROM A TAX IN EXCESS OF FOUR PERCENT (4%) <br /> OF THE CONSIDERATION PAID BY AN OCCUPANT OF THE <br /> SLEEPING ROOM TO THE HOTEL MAY ONLY BE USED FOR <br /> CONVENTION CENTER IMPROVEMENTS, FACILITIES AND <br /> PERSONNEL FOR THE REGISTRATION OF CONVENTIONEERS <br /> AND ADVERTISING AND PROMOTING THE CITY; TO PROVIDE <br /> THAT NO MORE THAN ONE PERCENT (1%) OF THE CONSIDERA- <br /> TION PAID BY SUCH AN OCCUPANT MAY BE USED FOR THE <br /> ENCOURAGEMENT, PROMOTION, IMPROVEMENTS AND APPLICA- <br /> TION OF THE ARTS; TO AUTHORIZE ENFORCEMENT ACTIONS <br /> BY SAID CITY TO CLOSE DOWN HOTELS DELINQUENT IN THE <br /> PAYMENT OF SAID TAX AND DECLARING AN EFFECTIVE DATE. <br /> Mr. Guerra moved for adoption of the Ordinance on third and final <br /> reading and Mr. Moore seconded the motion. Mr. Brown then moved <br /> the Ordinance be amended to be adopted on emergency rather than third <br /> and final reading so that the effective date could be after publica- <br /> tion in a newspaper of general circulation instead of ten days after <br /> adoption of the Ordinance, and that the effective date of the Ordin- <br /> ance be October 1, 1983. Mr. Farr seconded the amendment. Mr. Brown <br /> then moved to amend the Ordinance to be increased two cents rather <br /> than three cents and Mr. Farr seconded the motion. Mr. Brown said <br /> he had met with interested hotel persons and that a feasibility study <br /> is being prepared through the Chamber of Commerce and that the three <br /> cent increase may not be needed. On roll call of the amendment to <br /> increase 2 cents rather than 3 cents, the following vote was recorded: <br /> AYE: Brown, Farr. <br /> NAY: Guerra, Craddock, Kissler, Kreczmer, Moore. <br /> ABSTAIN: None. <br /> The motion failed. The Council then unanimously adopted the Ordinance <br /> on emergency with the effective date to be October 1, 1983. <br /> Mayor Craddock introduced for consideration the adoption of an Ordin- <br /> ance on third and final reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br /> WHICH REGULATES AND RESTRICTS AND LOCATION AND USE <br /> OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br /> 29, 1980 (VOL. 54) BY CHANGING THE ZONING OF LOT <br /> NOS. 121 AND 122, IN BLOCK NO. 12, WESTOVER ADDITION, <br /> A/K/A 1408 AND 1410 EARLE, RESPECTIVELY, FROM IIR-l" <br /> (SINGLE-FAMILY DWELLING DISTRICT) TO IIR-2" (DUPLEX <br /> OR TWO-FAMILY DWELLING DISTRICT). <br />
