<br /> Mayor Craddock asked if anyone wished to speak in favor of the zon-
<br /> ing request, and no one did. Mayor Craddock asked if anyone wished
<br /> to speak in opposition to the zoning request, and no one did, so Mayor
<br /> Craddock closed the public hearing. The Zoning Commission had denied
<br /> the zoning change, so it would require six votes of approval of the
<br /> Council to pass on first reading. The Council had concerns about
<br /> the property being in the floodway and flood plain. After discussion,
<br /> Mr. Guerra moved to deny the zoning Ordinance and Mr. Brown seconded
<br /> the motion. On roll call the following vote was recorded:
<br /> AYE: Brown, Farr, Guerra, Craddock, Kissler, Kreczmer.
<br /> NAY: Moore.
<br /> ABSTAIN: None.
<br /> Mayor Craddock opened a public hearing to consider annexation of
<br /> 121. 43 acres, more or less, of land out of the J. M. Veramendi Sur-
<br /> vey No. 1, A-17, in Hays County, Texas, said land being located on
<br /> IH35 South (JASBA). Mayor Craddock asked if anyone wished to speak
<br /> in favor of the annexation. Brad B~rns was present representing the
<br /> owner of the property. There was a discussion concerning the utili-
<br /> ties, and the developer would have to pay for the extension of the
<br /> utilities, 8 inch sewer line and 12 inch water line. Jerry Hare,
<br /> also representing the owner, stated the owner would use a water pro-
<br /> cess and mud for the making of tile. The water would be recycled on
<br /> the site. City Manager Gonzalez stated the Staff was working with
<br /> the developer regarding streets, utilities and easements needed. Mayor
<br /> Craddock asked if anyone else wished to speak in favor of the annexa-
<br /> tion request and no one did, so she asked if anyone wished to speak
<br /> in opposition to the request, and no one did, so she closed the public
<br /> hearing. The service plan was made available for the public hearing.
<br /> Mayor Craddock introduced for consideration the adoption of an Ordin-
<br /> ance on emergency, the caption which was read as follows:
<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS, APPROVING THE PRICE AND CONDITIONS OF
<br /> THE SALE BY THE CITY OF SAN MARCOS, TEXAS, OF LOTS
<br /> SEVEN (7) AND EIGHT (8) IN BLOCK NINE (9), VICTORY
<br /> GARDENS, SECTION ONE (1), A SUBDIVISION LOCATED IN
<br /> SAID CITY, TO GABRIEL VASQUEZ AND WIFE, MARIA LUISA
<br /> VASQUEZ; AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY
<br /> DEED TO GABRIEL VASQUEZ AND WIFE, MARIA LUISA VASQUEZ
<br /> AND DECLARING AN EMERGENCY.
<br /> Mr. Farr moved for adoption of the Ordinance on emergency and Mayor
<br /> Craddock seconded the motion, which passed unanimously.
<br /> Mayor Craddock introduced for consideration approval of an Ordinance
<br /> on first reading, the caption which was read as follows:

<br /> MARCOS, TEXAS, AMENDING ORDINANCE 1983-45, ADOPTED
<br /> SEPTEMBER 12, 1983, WHICH SET FORTH AN ITEMIZED ESTIM-
<br /> ATE OF THE EXPENSE OF CONDUCTING EACH ADMINISTRATIVE
<br /> UNIT OF THE MUNICIPAL GOVERNMENT OF SAID CITY FOR THE
<br /> FISCAL YEAR BEGINNING OCTOBER 1, 1983, AND ENDING ON
<br /> SEPTEMBER 30, 1984, AND APPROPRIATED MONEY FOR THE
<br /> VARIOUS FUNDS AND PURPOSES OF SUCH ESTIMATE, TO REVISE
<br /> SAID ESTIMATES AND TO REAPPROPRIATE SAID FUNDS; ADOPT-
