<br /> (7) Subject to this agreement, accept as each <br /> party's certified service areas, including the <br /> dual certified service area, as those <br /> certified service areas presently exist and <br /> are designate~ by the Texas Water Commission. <br /> III. CRYSTAL CLEAR'S AGREEMENT: <br /> Crystal Clear agrees to: <br /> ( 1) Conform with and require developers and <br /> other individuals requesting water service <br /> from Crystal Clear within the dual certified <br /> service area to conform with City, state and <br /> Federal water utilities specifications, as <br /> supplied by the City, from the effective date <br /> of this agreement, in all water system <br /> construction activities. <br /> ( 2) Provide the City a copy of proposed plans <br /> for commercial, industrial and/or residential <br /> developments in the dual certified service <br /> area for review, recommendations and approval <br /> prior to start of construction of any water <br /> system improvements. <br /> ( 3) Allow timely inspection by City, State and <br /> Federal personnel to ensure conformity to <br /> City, State and Federal standards. <br /> ( 4) Permit the City to collect revenues from <br /> customers within the dual certified service <br /> area, who are serviced by the City as <br /> authorized by this agreement. <br /> ( 5) Cooperate with the City's efforts to <br /> comply with the Texas Water Commission, or any <br /> other governmental agencies rules and <br /> regulations in the future. <br /> IV. THE CITY'S AGREEMENT: <br /> The City agrees to: <br /> ( 1) Develop and update standards and <br /> specifications for water utility system <br /> improvements in the City's extraterritorial <br /> jurisdiction, deliver a copy of said standards <br /> and specifications to the office of Crystal <br /> Clear and make timely inspections of <br /> -3- <br />
