166 STATE TEXAS WATERSHED Upper San Marcos River - UNITED STATES DEPARTMENT OF AGRICULTURE SOIL CONSERVATION SERVICE PROJECT AGREEMENT THIS AGREEMENT, made this 24th day of April , 1990, by and between the City of San Marcos, called the City, and the Soil Conservation Service, United States Department of Agriculture, called SCS, WITNESSETH THAT: WHEREAS, under the provisions of the Watershed Protection and Flood Prevention Act, the City and SCS agreed to a plan for the above watershed, which provides for installation of certain works of improvement. NOW THEREFORE, in consideration of the premises and of the several promises to be faithfully performed by the parties hereto as set forth, the City and SCS do hereby agree as follows: A. It is agreed that the following described work, including vegetating is to be performed at an estimated cost of $470,00O.0~. II 4°",000.001.;::-::- Construction of Recreation Facilities B. The City will: 1. Accept all financial and other responsibility for excess costs resulting from their failure t9 obtain or delay in obtaining adequate land and water rights, permits and licenses needed for the works of improvement described in Section A. 2. Provide 50 percent of the cost of constructing the works of improvement described in Section A. This cost to the City is estimated to be $2J5,00Q.OO..;L... :Zo3IOOO, 00 -' 3. Reimburse to SCS its share of the cost for construction as hereinafter provided: 2-03,O00, OOl£ a. Funds in the amount of $£35,800.00 ~re to be reimbursed to SCS for construction of the works of improvement. Reimbursement will be made on a monthly basis upon receipt of invoice from SCS and will be based on actual construction costs. b. As may be required in the prosecution of the work and upon notification by SCS, the City will provide additional funds to SCS in such amounts as may be necessary to cover the City's share of construction costs.
