<br /> vertical control measurements, topography, profiles, and cross <br /> sections. The OWNER shall provide field surveys for construction <br /> purposes which generally include the layout of structures, <br /> pipelines, roadways, quantity and measurement determinations, and <br /> surveys required to establish location of land boundaries and <br /> corners. The CONSULTANT shall establish the scope of said surveys <br /> as set forth in Article 3, Paragraph 3.2.5. <br /> 6.1.5 Furnish the CONSULTANT necessary geotechnical soil and <br /> foundation investigations data and reports, the scope of which <br /> shall be determined by the CONSULTANT. <br /> 6.1.6 Acquire all land and right-of-way required for the <br /> PROJECT and any related off-site work, if any. <br /> 6.1.7 Respond promptly, in writing, to requests by the <br /> CONSULTANT for authorization to proceed with specific activities <br /> deemed desirable and as set forth hereinbefore. <br /> 6.1.8 The OWNER agrees to require a provision in the <br /> construction Contract Documents to the effect that the Contractor <br /> will hold harmless the CONSULTANT and the OWNER for the acts of <br /> employees or representatives of the Contractor. The OWNER will <br /> require all insurance coverage of the Contractor to name the OWNER <br /> and the CONSULTANT as additional insured parties. <br /> ARTICLE 7 <br /> SPECIAL CONSIDERATIONS <br /> 7.1 OWNERSHIP OF DOCUMENTS <br /> 7.1.1 Original documents, such as tracings, plans, <br /> specifications, maps, basic survey notes and sketches, charts, <br /> computations, and other data prepared or obtained under the terms <br /> of this AGREEMENT, shall become the property of the OWNER. OWNER <br /> agrees to hold CONSULTANT harmless in connection with any <br /> subsequent use made of these documents by the OWNER. After <br /> completion of the PROJECT, reproducible copies of drawings <br /> modified to show "as built" conditions, will be supplied to the <br /> OWNER and the FAA, and will become the OWNER's property. <br /> 7.1.2 Should any provision in this AGREEMENT be found or <br /> deemed to be invalid, this AGREEMENT shall be construed as not <br /> containing the provision, and all other provisions which are <br /> otherwise lawful shall remain in full force and effect, and to <br /> this end the provisions of this AGREEMENT are declared to be <br /> severable. <br /> 7.1.3 Services provided within this AGREEMENT are for the <br /> exclusive use of the City of San Marcos. <br /> -12- <br />
