construction, the appropriate time for testing, the ASTM test designation, name by which the test is commonly referred, and the frequency of testing required. The plan will be reviewed by the FAA project manager and must be approved along with the final plans and specifications for construction. 3.4 PHASE 3 - ADMINISTRATION OF CONSTRUCTION Upon approval by the OWNER and the FAA of the construction plans, specifications, and contract documents, Phase 3 of this AGREEMENT will commence, and the CONSULTANT shall perform Administration of Construction, as follows: 3.4.1 Assist the OWNER in the advertisement of the PROJECT for bids. 3.4.2 Assist the OWNER in holding a pre-bid conference. 3.4.3 Assist the OWNER in filing documents required for the approval of governmental authorities having jurisdiction over the PROJECT, and assist the OWNER's attorney in the preparation of formal construction Contract Documents. 3.4.4 Assist in obtaining bids, opening bids, tabulating bids, and in awarding the contract for construction. The CONSULTANT shall assist the OWNER in reviewing the Statement of Bidder's Qualifications, financial statements of bidders (if required), lists of bidders' proposed subcontractors, and shall make a recommendation to OWNER regarding award of bid. CONSULTANT shall also answer all questions of prospective or potential bidders and shall make all necessary clarifications and interpretations of the Contract Documents. However, CONSULTANT shall have no authority to issue a Notice To Proceed to the contractor. 3.4.5 Unless otherwise provided in this AGREEMENT and incorporated in the Contract Documents, the CONSULTANT shall provide administration of the Contract for Construction as set forth herein and in the Contract Documents approved by OWNER. CONSULTANT's administration of the contract for construction shall be provided in strict adherence with the Contract Documents and CONSULTANT shall not pursue a course of conduct which might jeopardize any of OWNER's rights thereunder. Minor deviations from Contract Documents that do not affect the validity of performance (bonds) are permitted. 3.4.6 The CONSULTANT shall be a representative but not an agent of the OWNER during the Construction Phase, and shall advise and consult with the OWNER. OWNER's instruction to the Contractor shall be forwarded through the CONSULTANT, unless (1) CONSULTANT is unavailable by telephonic communication or otherwise to issue instructions necessary for the proper progress and acceptance of -5-
