<br /> construction, the appropriate time for testing, the ASTM test <br /> designation, name by which the test is commonly referred, and the <br /> frequency of testing required. The plan will be reviewed by the <br /> FAA project manager and must be approved along with the final <br /> plans and specifications for construction. <br /> 3.4 PHASE 3 - ADMINISTRATION OF CONSTRUCTION <br /> Upon approval by the OWNER and the FAA of the construction <br /> plans, specifications, and contract documents, Phase 3 of this <br /> AGREEMENT will commence, and the CONSULTANT shall perform <br /> Administration of Construction, as follows: <br /> 3.4.1 Assist the OWNER in the advertisement of the PROJECT <br /> for bids. <br /> 3.4.2 Assist the OWNER in holding a pre-bid conference. <br /> 3.4.3 Assist the OWNER in filing documents required for the <br /> approval of governmental authorities having jurisdiction over the <br /> PROJECT, and assist the OWNER's attorney in the preparation of <br /> formal construction Contract Documents. <br /> 3.4.4 Assist in obtaining bids, opening bids, tabulating <br /> bids, and in awarding the contract for construction. The <br /> CONSULTANT shall assist the OWNER in reviewing the Statement of <br /> Bidder's Qualifications, financial statements of bidders (if <br /> required), lists of bidders' proposed subcontractors, and shall <br /> make a recommendation to OWNER regarding award of bid. CONSULTANT <br /> shall also answer all questions of prospective or potential <br /> bidders and shall make all necessary clarifications and <br /> interpretations of the Contract Documents. However, CONSULTANT <br /> shall have no authority to issue a Notice To Proceed to the <br /> contractor. <br /> 3.4.5 Unless otherwise provided in this AGREEMENT and <br /> incorporated in the Contract Documents, the CONSULTANT shall <br /> provide administration of the Contract for Construction as set <br /> forth herein and in the Contract Documents approved by OWNER. <br /> CONSULTANT's administration of the contract for construction shall <br /> be provided in strict adherence with the Contract Documents and <br /> CONSULTANT shall not pursue a course of conduct which might <br /> jeopardize any of OWNER's rights thereunder. Minor deviations <br /> from Contract Documents that do not affect the validity of <br /> performance (bonds) are permitted. <br /> 3.4.6 The CONSULTANT shall be a representative but not an <br /> agent of the OWNER during the Construction Phase, and shall advise <br /> and consult with the OWNER. OWNER's instruction to the Contractor <br /> shall be forwarded through the CONSULTANT, unless (1) CONSULTANT <br /> is unavailable by telephonic communication or otherwise to issue <br /> instructions necessary for the proper progress and acceptance of <br /> -5- <br />
