<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS, CANVASSING RETURNS AND DECLARING
<br /> RESULTS OF THE SPECIAL AND GENERAL ELECTION HELD ON
<br /> MAY 5, 199Ø FOR THE PURPOSE OF ELECTING A MAYOR, A
<br /> CITY COUNCIL MEMBER, PLACE THREE, AND A CITY
<br /> COUNCIL MEMBER, PLACE FOUR, SUBMITTING TO THE
<br /> VOTERS VARIOUS PROPOSITIONS INCLUDING PROPOSED
<br /> AMENDMENTS TO THE CITY CHARTER, A PROPOSED RENEWAL
<br /> OF A LEASE OF CITY PARK PROPERTY TO THE SAN MARCOS
<br /> LIONS CLUB, AND A REFERENDUM ON ADOPTION OF AN
<br /> ORDINANCE DESIGNATING REINVESTMENT ZONE NO. FIVE OF
<br /> THE CITY OF SAN !>1ARCOS, TEXAS; AND DECLARING AN
<br /> EMERGENCY.
<br /> WHEREAS, the City Counc il of the City of San Marcos, Texas,
<br /> by ordinance duly enacted on February 12, 199Ø, and amended on
<br /> February 26, 199Ø, ordered that a Special and General election be
<br /> held on May 5, 199Ø for the purpose of electing a Mayor, City
<br /> Council member, place three and a City Council member, place four,
<br /> and submitting to the voters various propositions including
<br /> proposed amendments to the City Charter, a proposed renewal of a
<br /> lease of city park property to the San Marcos Lions Club, and
<br /> referendum on adoption of an ordinance designating Reinvestment
<br /> Zone No. Five of the City of San Marcos, Texas; and,
<br /> \'lHEREAS, notice of this election was duly published in the
<br /> San Marcos Daily Record on April 8, 199Ø, April 15, 199Ø; and,
<br /> WHEREAS, copies of this notice were duly posted at each city
<br /> election precinct polling place prior to the election, and a copy
<br /> a f the notice was posted on the bulletin board at City Hall on or
<br /> before March 21, 199Ø; and,
<br /> \vHEREAS, this election was duly and legally held on the 5th
<br /> day of May, 199Ø, in conformity with the election laws of the
<br /> State of Texas, and the results of the election have been
<br /> certified and returned by the proper judges and clerks thereof;
<br /> and,
<br /> WHEREAS, the City Council of the City of San Marcos, Texas,
<br /> with the following members present: Kathy M. Morris, Billy G. Moore
<br /> Rick Hernandez , Ronald K. Hart , Fred Guerra ,
<br /> andBetty Jane Klssler has today considered
<br /> the returns of the Special and General election held on the 5th
<br /> day of May, 199Ø: and,
<br /> WHEREAS, it appears to the Council, and the Council so find s ,
<br /> that the the election was in all respects lawfully held: and,
<br /> WHEREAS, it appears to the Council, and the Council so finds,
<br /> that the tabulation of the results of the election is correct;
<br /> now, therefore,
<br /> BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
<br /> SAN MARCOS, TEXAS:
<br /> SECTION 1. That the Special and General City election of
<br /> May 5, 199Ø was duly called, that notice of the election was given
<br /> in accordance with law, and that the election was held in
<br /> accordance with law.
<br /> SECTION 2. That the tabulation of votes cast in the
<br /> Special and General election held on May 5, 199Ø for the purpose
<br /> of electing a Mayor, City Council member, place three, and a City
<br /> Council member, place four, and submitting to the voters varlOUS
<br /> propositions including proposed amendments to the City Charter, a
<br /> proposed renewal of a lease of city park property to the San
<br /> Marcos Lions Cl ub, and referendum on adoption of an ordinance
<br /> designating Reinvestment Zone No. Five of the City of San Marcos,
<br /> Texas, made and certified to by the City Secretary of the City of
<br /> San Marcos, a copy of which is attached hereto and made a part
<br />
