<br /> 31 <br /> FACILITIES MAINTENANCE AGREEMENT <br /> STATE OF TEXAS <br /> KNOW ALL PERSONS BY THESE PRESENTS <br /> COUNTY OF HAYS <br /> 1. Parties: The City of San Marcos, Texas, a Texas municipal <br /> corporation (the "City") and Southwest Texas State University (the <br /> "University"), each acting through its duly authorized representative. <br /> 2. Recitals: <br /> a. The University contracts with Texas Special Olympics, a <br /> Texas non-profit corporation (the "Special Olympics") for <br /> the conducting of the annual Special Olympics Summer Games <br /> at various facilities of the University, including <br /> training fields, the University Stadium, dormitories, <br /> dining facilities, gymnasiums and auditoriums; and, <br /> b. The Texas Special Olympics Summer Games is attended by <br /> approximately 7,000 out-of-town persons and a large <br /> press contingent, and directly and indirectly stimulates <br /> tourism and tourist activities in the City; <br /> and, <br /> c. The City wishes to assist the University in the <br /> maintenance of the various facilities of the University <br /> used by the Special Olympics and by the public in <br /> connection with the operation of the 1990 Special <br /> Olympics Summer Games; and, <br /> d. The City, in providing funding for this agreement, directs <br /> an expenditure of Hotel-Motel Tax Reve-nue in accordance <br />
