<br /> -2- <br /> with its duly adopted budget for the 1989-1990 fiscal <br /> year, and in accordance with the general purposes of <br /> facilities maintenance described in 351.101(a)(l) of the <br /> Texas Tax Code, as amended. <br /> 3. City's Agreement: The City agrees to contribute to the <br /> University the sum of Ten Thousand and no/1OO Dollars ($10,000.00) <br /> towards the maintenance of the various facilities of the University <br /> used by the Special Olympics and by the public in connection with the <br /> operation of the 1990 Special Olympics Summer Games to be conducted <br /> during May, 1990. The City agrees to make this contribution not late r <br /> than May 31, 1990. <br /> 4. University's Agreement: The University agrees to use the <br /> <br /> contribution made by the City only for the purpose of defraying its <br /> maintenance expenses in connection with the conducting of the <br /> Special Olympics Summer Games as described above. The University <br /> expressly acknowledges that the use of these funds is limited by reason <br /> of their nature as Hotel-Motel tax revenues under Chapter 351 of the <br /> Texas Tax Code, as amended. The University agrees to maintain <br /> complete and accurate financial records regarding expenditures from <br /> this contribution, and shall make these records available for <br /> inspection and review upon written request by the City Manager of <br /> the City. The University agrees that if it cannot for any reason use <br /> all or any part of the contribution for the purposes specified, it <br /> shall immediately refund the entire unused amount to the City. <br />
