<br /> 34 <br /> SURVEYING SERVICES AGREEMENT <br /> STATE OF TEXAS )( <br /> COUNTY OF HAYS )( <br /> THIS AGREEMENT made, entered into, and executed this ~ day of May , 1990, by <br /> and between the City of San Marcos, Texas, organized and existing under the laws of the State of Texas <br /> and situated in Hays County, Texas, acting through authority conferred on by its Mayor or his designee, <br /> hereinafter called "OWNER" and Charles R. Swart, hereinafter called "SURVEYOR". <br /> WHEREAS, the OWNER desires to obtain surveying services in connection with the design of the <br /> reconstruction of Runway 8-26, reconstruction of Taxiway "A", new M.I.R.L. for Runway 8-26 and <br /> associated non-lighted wind cones, hereinafter called the "PROJECr': <br /> WHEREAS, the OWNER desires to obtain professional surveying services in connection with the <br /> PROJECT to make a topographic survey and physical features survey related to the proposed PROJECT <br /> in accordance with the limits shown on the attached Topographic and Physical Features Survey Map. <br /> WHEREAS, the SURVEYOR is qualified and capable of performing the professional services <br /> proposed herein, is acceptable tò the OWNER, and is willing to enter into a contract with the OWNER to <br /> perform such services. <br /> NOW, THEREFORE, be it resolved that the parties hereto do mutually agree as follows: <br /> ARTICLE 1 <br /> EMPLOYMENT OF THE SURVEYOR <br /> 1.1 The OWNER agrees to retain the SURVEYOR and the SURVEYOR agrees to perform the <br /> professional surveying services in connection with the PROJECT as set forth in sections following, and the <br /> OWNER agrees to pay; and the SURVEYOR agrees to accept fees as specified in sections following as <br /> full and final compensation for the work accomplished. <br /> ARTICLE 2 <br /> SURVEYING SERVICES <br /> 2.1 BASIC SERVICES <br /> 2.1.1 The SURVEYOR agrees to perform professional services in connection with the PROJECT <br /> as hereinafter stated, including the stipulations within the AGREEMENT. Services to be furnished under <br /> this contract shall be limited to the following items unless expanded or reduced in the manner set forth in <br /> Article 2. Surveyor shall provide: <br /> 1. All physical features within the designated limits. This will include to the best of ability all <br /> existing electrical ducts and duct markers to help establish route of new wiring for M.LR.L. <br /> of Runway 8-26. <br />
