<br /> 43 <br /> RE~OLtTTrON 1990- 54 R <br /> --- <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, ADOPTING A PROPOSED PLAN FOR THE <br /> MANAGEMENT OF THE WATER RESOURCES OF THE EDWARDS <br /> AQUIFER: AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the Edwards Aquifer is essential to the quality of life <br /> and the economic and environmental well-being of San Marcos and Central <br /> Texas, and, <br /> WHEREAS, the Edwards Aquifer is the source of the San Marcos <br /> Springs and the San Marcos River, which offer a unique habitat to <br /> several endangered species of plants and animals, and, <br /> WHEREAS, the Edwards Aquifer faces both immediate and long-term <br /> threats to its abundance and quality from drought and regional ove r- <br /> pumping; and, <br /> WHEREAS, the management of the water resources of the Edwards <br /> Aquifer is the subject of pending litigation initiated by the <br /> Guadalupe-Blanco River Authority regarding the nature and allocation of <br /> rights to those resources and threatened litigation involving the <br /> unique animal and plant life present at the San Marcos Springs and <br /> Comal Springs which are protected under the provisions of the Federal <br /> Endangered Species Act: and, <br /> WHEREAS, the management of these water resources is the subject of <br /> study by the Texas Legislature and the Texas Water Commission for <br /> purposes of determining a legislative solution to the issues raised in <br /> the pending and threatened litigation described above; and, <br /> WHEREAS, the City Council desirep to state the position of the <br /> City of San Marcos on the management of these water resources for the <br /> purpose of providing input to the studies being undertaken by the <br /> Texas Legislature and the Texas Water Commission. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS. <br /> PART 1. That the Proposed Plan for the Management of the Water <br /> Resources of the Edwards Aquifer, a copy of which is attached to this <br /> Resolution, is hereby approved and adopted. <br /> PART 2.
