<br /> G. The District shall be responsible for <br /> implementation and management of the regional water <br /> management plan. <br /> IV. Transfer or ~easing of Edwards Aquifer water <br /> A. The transfer or leasing of the right to use <br /> groundwater within the Edwards aquifer region is <br /> limited to the maximum amount of water actually <br /> used within the past 24 months. <br /> B. The transfer or leasing of the right to use <br /> groundwater between counties within the district is <br /> limited in the following manner: <br /> I} From irrigation to non-irrigation use, only <br /> one acre foot of water for each acre of land <br /> actually irrigated within the last 24 months <br /> shall be transferred or leased. <br /> 2} From non-irrigation to non-irrigation use, <br /> only 50% of the maximum amount of water <br /> actually used within the past 24 months shall <br /> be leased or transferred. <br /> 3} The term of any lease or transfer shall not <br /> exceed three years. <br /> C. A lease or transfer cannot be executed for any <br /> abandoned well, as defined by TWC rule or statute. <br /> D. The seller shall not use any well and/or irrigate <br /> any tract of land for which the water has been <br /> transferred or leased. This prohibition lasts for <br /> the term of the transfe¡ or lease. <br /> V. Exportation of Edwards Water <br /> By the year 2000, any physical exportation of Edwards <br /> water outside the District, for other than an aquifer <br /> storage and recovery project, will be limited to no more <br /> than 70% of the maximum amount of water taken on an <br /> annual basis prior to January 1, 1990, or the maximum <br /> amount of water granted by permit from the present <br /> Edwards Underground Water District. <br /> VI. Oversight by the Texas Water Commission <br /> A. The Texas Water Commission shall review, receive <br /> comments, and approve the Regional Water Management <br /> Plan. <br /> 5 <br />
