<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF
<br />THE CITY BY ZONING BLOCK 1, LOTS 1, 2 AND PART OF LOT
<br />0 3 OUT OF THE CARROLL/HOFHEINZ ADDITION TO THE CITY OF

<br />f'c. SINGLE- FAMILY DWELLING DISTRICT (LOW DENSITY) TO "c"
<br />COMMERCIAL DISTRICT AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on March 20, 1990, the Joint Planing and Zoning
<br />Commissions of the City of San Marcos held a public hearing
<br />regarding a request to change the zoning from "R-l" Single-Family
<br />Dwelling District (Low Density) to "C" Commercial District for Block
<br />1, Lots 1, 2 and part of Lot 3 out of the Carroll/Hofheinz
<br />Addition, Hays County, Texas, located at 1320, 1326 and 1402 W.
<br />Hopkins, San Marcos, Texas; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Zoning Commission did, on March 20, 1990, consider the request and
<br />voted to approve it and has recommended that the request
<br />be approved by the City Council of the City¡
<br />and,
<br />
<br />WHEREAS, the City Council held a public hearing on the ?q+-h day
<br />of May, 1990, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the Official Zoning Map of the City, as described
<br />in Section 3 of the General Zoning Ordinance is hereby amended
<br />to rezone the following described real property located in San Marcos,
<br />Hays County, Texas, which is presently zoned "R-l" Single-Family
<br />Dwelling District (Low Density) to "c" Commercial District:
<br />
<br />Block l, Lots 1, 2 and part of 3 out of the Carro1l/Hofheinz
<br />Addition to the City of San Marcos, Hays County as recorded in
<br />Volume 50, Page 360 of the Hays County Deed Records; the
<br />part of Lot 3 included being described as follows:
<br />
<br />Field notes describing a part of Lot 3, of the Carroll/Hofheinz
<br />Addition, according to the map or plat thereof recorded in
<br />Volume 50, Page 361, Deed Records of Hays County, Texas, and
<br />being more particularly described by metes and bounds as
<br />follows:
<br />
<br />Beginning at a point that marks the South corner of Lot 2, and
<br />the East corner of Lot 3, of the afore mentioned
<br />CARROLL/HOFHEINZ ADDITION, said point being on the Northwest
<br />line of Hopkins Street and also being the East corner of the
<br />herein described parcel;
<br />
<br />Thence, S 45 degrees W, along the Northwest line of Hopkins
<br />Street, a distance of 70' to a point, said point being the South
<br />corner of the herein described parcel;
<br />
<br />Thence, N 45 degrees W, a distance of l50' to a point on the
<br />Southeast line of Hofheinz Street (an unopened street), said
<br />point being the West corner of the herein described parcel;
<br />
<br />Thence, N 45 degrees E, along the Southeast line of Hofheinz
<br />Street, a distance of 70' to a point, said point being the West
<br />corner of Lot 2, the North corner of Lot 3 and the North Corner
<br />of the herein described parcel;
