Appealls 1 <br />The applicant may appeal a decision of the Director conditionally approving or denying a Minor Subdivision Plat to <br />the Planning and Zoning Commission. The appeal shall be processed and decided in accordance with Article 10, Division <br />2. <br />Section 1...6 „"T...6 ,,. Cirliiteirliia for Appirovall l <br />The Director, or the Planning and Zoning Commission on appeal, shall decide whether to approve, conditionally <br />approve or deny the Minor Subdivision Plat application based upon the following criteria: <br />(a) The Minor Subdivision Plat is consistent with all zoning requirements for the property, all other requirements of <br />this Land Development Code that apply to the plat, and any approved development agreement; <br />(b) The Minor Subdivision Plat conforms to the approved Watershed Protection Plan (Phase 2); <br />(c) All lots to be created by the plat already are adequately served by all required City utilities and services, and <br />(d) The plat does not require the extension of any municipal facilities to serve any lot within the subdivision. <br />Section 1...6.7.7 ,,. Ilf;;° Ipiiiir tiiioin <br />The approval of a Minor Subdivision Plat application shall remain in effect for a period of two years from the date that <br />the application was approved or conditionally approved by the Director or the Planning and Zoning Commission on <br />appeal, during which period the applicant shall make progress towards completion of the plat (as defined in Section <br />245.005(c) of the Texas Local Government Code, as amended). If no progress has been made towards completion of the <br />Minor Subdivision Plat within the two -year period, the Minor Subdivision Plat approval shall expire and the plat shall be <br />deemed null and void. If progress is made towards completion of the Minor Subdivision Plat (as defined in Section <br />245.005(c) of the Texas Local Government Code, as amended) during a distinct period of time within the two -year period, <br />but after such distinct period, no further progress is made towards completion of the Minor Development Plat for the land <br />subject to the plat (as defined in Section 245.005(c) of the Texas Local Government Code, as amended) for a two -year <br />period, the Minor Development Plat approval shall expire and the plat shall be null and void, unless extended in <br />accordance with Article 3, Division 5 of this Chapter 1. <br />Section 1...6 „"T „6 ,,. Recordation <br />The property owner shall submit the approved Minor Subdivision Plat, following any required revisions, to the <br />responsible official, who shall cause the Minor Subdivision Plat to be recorded in the property records of the county in <br />which the land is located. <br />San Marcos, Texas, Code of Ordinances Page 98 <br />
