The purpose of a Watershed Protection Plan shall be to apply the environmental and flood control <br />standards contained in Chapter 5 to a conceptual development design. A Watershed Protection Plan assures that <br />such standards will be met at the time of development of the property by establishing terms and conditions for <br />approval of applications for plats and Site Preparation Permits. For purposes of this Code, an Aquifer Protection Plan <br />and a Site Plan for land in the San Marcos River Corridor which was under prior regulations for or in association with <br />a plat application are Watershed Protection Plans. <br />(b) Applicability. Except as provided in subsections (c) or (d), approval of a Watershed Protection Plan is required within <br />the City limits or within the City's extraterritorial jurisdiction prior to approval of a plat application or, for developments <br />where a plat already has been approved for the property, prior to approval of a Site Preparation Permit. A Watershed <br />Protection Plan shall include all land contiguous to and in the same ownership with the land subject to the plat <br />application or Site Preparation Permit, except a remainder tract. <br />(c) Exceptions. A Watershed Protection Plan is not required for any land that is expressly exempted from the <br />environmental standards contained in Chapter 5, Articles 1-4 of the Land Development Code. <br />(d) Effect. Approval of a Watershed Protection Plan entitles the applicant to seek approval of a Cluster Development <br />Plan, plat application or Site Preparation Permit, as the case may be. <br />Section 1.7 1...2 ,,. Sequence of Approvals <br />(a) Phased Plans. An application for a Watershed Protection Plan typically shall be prepared and acted upon by the City <br />in two phases. <br />(1) A Watershed Protection Plan (Phase 1) shall be prepared prior to approval of the following types of <br />development applications: <br />a. Utility Extension, <br />b. Development Transfer Petition, <br />c. Subdivision Concept Plat, <br />d. Preliminary Subdivision Plat, <br />e. Preliminary Development Plat, <br />f. Cluster Development Plan. <br />(2) A Watershed Protection Plan (Phase 2), which shall contain greater detail than a Phase 1 Watershed Protection <br />Plan, shall be prepared prior to approval of the following types of development applications: <br />a. Minor Subdivision Plat or a replat, if the land is located within the Edwards Aquifer Recharge Zone, within a <br />designated stream or river corridor, or if the land contains floodplain, floodway or a waterway as defined by <br />this Code, <br />b.
