Subpart B - LAND DEVELOPMENT CODE <br />Chapter 1 - DEVELOPMENT PROCEDURES <br />ARTICLE 2: - AUTHORITY OF DECISION - MAKERS <br />DIVISION 2: - CITY STAFF <br />(5) Application for a Conditional Use Permit; <br />(6) Application for a Cluster Development Plan; <br />(7) Application for a special exception; <br />(8) Application for change in status of a nonconformity; <br />(9) Application for a Subdivision Concept Plat, Preliminary Subdivision Plat, Preliminary Development Plat, Final <br />Subdivision Plat, Final Development Plat, Minor Subdivision Plat, and replat; <br />(10) Application for a sign permit; <br />(11) Appeal of a decision on any application for which the Director is the responsible official; <br />(12) Variance petition for any application for which the Director is the responsible official; <br />(13) Vested rights petition for any decision where the Director is the responsible official for the application for which <br />the vested rights petition is filed; <br />(14) Park fee decision; and <br />(15) Omnibus relief petition. <br />(b) Initial Decision - Maker. The II kanning Director is the initial decision -maker for the following types of development <br />applications and relief petitions, subject to appeal as provided in this Chapter 1: <br />(1) Application for a Minor Subdivision Plat; <br />(2) Application for a sign permit; <br />(3) Park fee decision; and <br />(4) Vested rights petition for any decision for which the Director is the initial decision - maker. <br />(c) The II "I:aRr;iRiq Director is hereby authorized to approve administrative adjustments to certain standards in this Code <br />as provided in this Section. An administrative adjustment may be approved if it does not materially affect or change <br />by more than ten percent factors such as, but not limited to, project density, land area or size, intensity of land uses, <br />parking or traffic generation. Any applicant that is denied a request for an administrative adjustment may apply or <br />petition for a variance under the applicable provisions of this Code; or, if no variance process is provided for the type <br />of adjustment requested, the applicant may appeal the decision of the II kannong ....Director in the same manner for <br />appeals of an official's decision to the Zoning Board of Adjustments under Section 1.2.5.3 <br />C) f. <br />Section 1...2...2...3 .- IIE: ingillineeiriling I1111iir toir <br />(a) Responsible Official. Engineering Director refers to the person or person designated by the City Manager to carry out <br />the duties of the Engineering Director as described in this Land Development Code. The Engineering Director is the <br />responsible official for the following types of development applications and relief petitions: <br />(1) Application for approval of construction plans, and all related construction management tasks, including without <br />limitation, approval of contracts for public improvements; <br />(2) Application for a Site Preparation Permit; <br />(3) Application for a Floodplain Permit; <br />(4) Application for a Watershed Protection Plan (Phase 1 and Phase 2); <br />(5) Petition for a Utility Extension Agreement; <br />San Marcos, Texas, Code of Ordinances Page 10 <br />
