Subpart B - LAND DEVELOPMENT CODE <br />Chapter 1 - DEVELOPMENT PROCEDURES <br />ARTICLE 2: - AUTHORITY OF DECISION - MAKERS <br />DIVISION 2: - CITY STAFF <br />(6) Appeal of a decision on any application for which the Director is the responsible official; <br />(7) Variance petition for any application for which the Director is the responsible official; <br />(8) Vested rights petition for any decision where the Director is the responsible official for the application for which <br />the vested rights petition is filed; and <br />(9) Petition for relief from a dedication or construction requirement. <br />(b) Initial Decision - Maker. The Engineering Director is the initial decision -maker for the following types of development <br />applications and relief petitions, subject to appeal as provided in this Chapter 1: <br />(1) Application for approval of construction plans, and all related construction management tasks, including without <br />limitation approval of a contract for public improvements; <br />(2) Application for a Site Preparation Permit; <br />(3) Application for a Floodplain Permit; <br />(4) Application for a Watershed Protection Plan (Phase 1 or Phase 2, not a Qualified Watershed Protection Plan); <br />and <br />(5) Impact fee decision; and <br />(6) Vested rights petition for any decision for which the Director is the initial decision - maker. <br />(c) Floodplain Administrator. The Engineering Director is the Floodplain Administrator for the City and shall carry out the <br />following duties and responsibilities: <br />(1) Maintain and hold open for public inspection all records pertaining to this Article. <br />(2) Review permit applications to determine whether proposed building sites will be reasonably safe from flooding. <br />(3) Review and approve or deny applications for Floodplain Permits required by this Article. <br />(4) Provide forms for post- construction elevation certificates and receive completed certificates, as needed, to <br />assist property owners in meeting the requirements for participation in the National Flood Insurance Program. <br />(5) Review and make recommendations regarding proposed appeals and letters of map revision initiated by <br />property owners. <br />(6) Coordinate the local review of proposed new flood insurance studies and flood insurance rate maps for the City <br />as required by the Federal Emergency Management Agency. <br />(7) Make the necessary interpretation, where interpretation is needed, as to the exact location of the boundaries of <br />the areas of special flood hazards, for example, where there appears to be a conflict between a mapped <br />boundary and actual field conditions. <br />(8) Endeavor to ensure that the flood- carrying capacity within the altered or relocated portion of any waterway is <br />maintained. <br />(9) Require that no new construction, substantial improvements or other development, including fill, shall be <br />permitted within zones Al -30 and AE of the community's FIRM, unless it is demonstrated that the cumulative <br />effect of the proposed development, when combined with all other existing and anticipated development, will not <br />increase the water surface elevation of the base flood more than one foot at any point within the community. <br />Section 1...2...2„ 1113uwiiilll iiiing Officlial <br />(a) The building official is the responsible official for and shall initially decide the following types of applications: <br />San Marcos, Texas, Code of Ordinances Page 11 <br />
