The purpose of a Preliminary Subdivision Plat shall be to determine the general layout of the subdivision, <br />the adequacy of public facilities needed to serve the intended development and the overall compliance of the land <br />division with applicable requirements of this Land Development Code. <br />(b) Exceptions. A Preliminary Subdivision Plat is not required, where the subdivider elects to submit only a Final <br />Subdivision Plat, accompanied by construction plans. <br />(c) Effect. Approval of a Preliminary Subdivision Plat shall authorize the subdivider to submit construction plans for <br />approval by the Engineering Director under Chapter 7 of this Land Development Code and, upon approval of such <br />plans, to construct public improvements to serve the subdivision in accordance therewith. Approval of a Preliminary <br />Subdivision Plat also shall authorize the subdivider to seek approval of a Final Subdivision Plat for the land subject to <br />the Preliminary Subdivision Plat. <br />Section 1...6...3...2 ,,. Sequence of Approvals <br />An application for a Preliminary Subdivision Plat shall not be approved unless the following petitions or development <br />permits, where applicable, have been approved and remain in effect for land to be subject to the proposed plat <br />(a) All legislative applications; <br />(b) Watershed Protection Plan (Phase 1); and <br />(c) Subdivision Concept Plat (where development is proposed in phases). <br />Section 1...6 „3 „3 ,,. AppIllicatiloin Requirements <br />(a) Responsible Official. The II 2kas7s7or7g ..- II' "NDirector shall be the responsible official for a Preliminary Subdivision Plat. <br />(b) Contents. An application for a Preliminary Subdivision Plat shall be prepared in accordance with Chapter 1 of the <br />Technical Manual. <br />The Planning and Zoning Commission shall decide whether to approve, approve with conditions or deny the <br />Preliminary Subdivision Plat application. The action of the Commission shall be noted on two copies of the Preliminary <br />Subdivision Plat, referenced and attached to any conditions determined. One copy shall be returned to the applicant and <br />the other retained in the City's files. A notation of the action taken on each Preliminary Subdivision Plat application and <br />the reasons for the action shall be entered in the minutes of the Commission. <br />Section 1...6...3 „6 ,,. The following criteria shall be used to determine whether the application for a <br />Preliminary Subdivision Plat shall be approved, approved with conditions, or denied where no Subdivision Concept <br />Plat has been approved for the land subject to the proposed plat: <br />(1) The plat is consistent with all zoning requirements for the property, and any approved development agreement; <br />(2) The plat conforms to the approved Watershed Protection Plan (Phase 1); <br />San Marcos, Texas, Code of Ordinances Page 82 <br />
