Subpart B - LAND DEVELOPMENT CODE <br />Chapter 1 - DEVELOPMENT PROCEDURES <br />ARTICLE 6: - PLATTING PROCEDURES <br />DIVISION 3: - PRELIMINARY SUBDIVISION PLATS <br />(3) The proposed provision and configuration of roads, water, wastewater, drainage and park facilities conform to <br />the master facilities plans for the facilities, including without limitation the water facilities, wastewater facilities, <br />transportation, drainage and other master facilities plans; <br />(4) The proposed provision and configuration of roads, water, wastewater, drainage and park facilities, and <br />easements and rights -of -way are adequate to serve the subdivision and meet applicable standards of Chapters <br />6 and 7 of this Land Development Code; and <br />(5) The plat meets any county standards to be applied under an interlocal agreement between the City and a <br />county under Tex. Loc. Gov't Code ch. 242, where the proposed development is located in whole or in part in <br />the extraterritorial jurisdiction of the City and in the county. <br />(b) Approved Subdivision Concept Plat. The following criteria shall be used to determine whether the application for a <br />Preliminary Subdivision Plat shall be approved, approved with conditions, or denied, where a Subdivision Concept <br />Plat has been approved for the land subject to the proposed plat: <br />(1) The plat conforms to the general layout of the Subdivision Concept Plat and is consistent with the phasing plan <br />approved therein; <br />(2) The proposed provision and configuration of roads, water, wastewater, drainage and park facilities, and <br />easements and rights -of -way are adequate to serve the subdivision and meet applicable standards of Chapters <br />6 and 7 of this Land Development Code; <br />(3) The plat conforms to the approved Watershed Protection Plan (Phase 1); and <br />(4) The plat meets any county standards to be applied under an interlocal agreement between the City and a <br />county under Tex. Loc. Gov't Code ch. 242, where the proposed development is located in whole or in part in <br />the extraterritorial jurisdiction of the City and in the county. <br />Section 1...6...3...6 ,,. IIf;;° Ipiiiir tiiioin <br />The approval of a Preliminary Subdivision Plat application shall remain in effect for a period of two years from the <br />date the application was approved or conditionally approved by the Planning and Zoning Commission, during which <br />period the applicant shall make progress towards completion of a Final Subdivision Plat for the land subject to the <br />Preliminary Subdivision Plat (as defined in V.T.C.A., Texas Local Government Code, Section 245.005(c) as amended). If <br />no progress is made towards completion of a Final Subdivision Plat for the land subject to the Preliminary Subdivision Plat <br />(as defined in V.T.C.A., Texas Local Government Code, Section 245.005(c) as amended) within the two year period, the <br />Preliminary Subdivision Plat approval shall expire and the plat shall be null and void, unless extended in accordance with <br />Article 3, Division 5 of this Chapter 1. If progress is made towards completion of a Final Subdivision Plat for the land <br />subject to the Preliminary Subdivision Plat (as defined in V.T.C.A., Texas Local Government Code, Section 245.005(c) as <br />amended) during the two year period, but after the progress is made, no further progress is made towards completion of a <br />Final Subdivision Plat for the land subject to the Preliminary Subdivision Plat (as defined in V.T.C.A., Texas Local <br />Government Code, Section 245.005(c) as amended) for a period of two years, the Preliminary Subdivision Plat approval <br />shall expire and the plat shall be null and void, unless extended in accordance with Article 3, Division 5 of this Chapter 1. <br />Section 1...6...3 „7 ,,. Minor changes in the design of the subdivision subject to a Preliminary Subdivision Plat may be <br />incorporated in an application for approval of a Final Subdivision Plat without the necessity of filing a new application <br />for approval of a Preliminary Subdivision Plat. Minor changes shall include adjustment in street or alley alignments, <br />lengths, and paving details, and adjustment of lot lines that do not result in creation of additional lots, provided that <br />such changes are consistent with any approved priority applications. <br />San Marcos, Texas, Code of Ordinances Page 83 <br />
